WHEREAS, on or about August 11, 2020 Plaintiffs in Malikul Aziz, et al. v. City of Newark, Docket Number 20-cv-10309 (JMV)(JAD) filed an action in the United States District Court for the District of New Jersey, seeking damages for alleged violations of the Fair Labor Standards Act and the New Jersey Wage Laws; and

 

WHEREAS, City Ordinance 2:6-2.4 provides certain limitations on the Corporation Counsel’s ability to resolve, settle and/or compromise causes of action; and

 

WHEREAS, City Ordinance 2:6-2.4 requires the Corporation Counsel to obtain approval from the Municipal Council to be empowered to settle or resolve certain cases and to permit, offer or accept any offer of judgment; and

 

                     WHEREAS, the Corporation Counsel seeks approval from the Municipal Council to engage in settlement discussions in this pending matter, including accepting and/or offering any offer of judgment.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designee, the Corporation Counsel, are approved, on behalf of the City of Newark to engage in settlement discussions in Malikul Aziz, et al. v. City of Newark, Docket Number 20-cv-10309 (JMV)(JAD) filed in the United States District Court for the District of New Jersey, including accepting and/or offering any offer of judgment.
