This Amendment will increase the contract amount by $29,590.00 for a new total contract amount not to exceed $129,590.00.

WHEREAS, Professional Engineering services are professional services and are exempt from the requirements for public bidding pursuant to the Local Public Contracts Law, more specifically, N.J.S.A. 40A:11-5(1)(a)(i); and
WHEREAS, the Municipal Council of the City of Newark, by Resolution 7R12-a, adopted on March 3, 2022, awarded a contract to Fastech Consulting Engineers, 235 Moore Street, Hackensack, New Jersey 07601, to provide Professional Engineering Services on an As-Needed Basis, in an amount not to exceed One Hundred Thousand Dollars and Zero Cents ($100,000.00), for a period of August 29, 2022 through August 28, 2023; and
WHEREAS, the legal corporatate entity name is Fastech Consulting, LLC d/b/a Fastech Consulting Engineers and the Director seeks to correct and amend the original contract to reflect the correct name; and
WHEREAS Fastech Consulting, LLC d/b/a Fastech Consulting Engineers, exhausted the $100,000.00 on or about May 30, 2023, during the contract term and continued to provide Professional Engineering Service at the request of the Director of the Department of Water and Sewer Utilities for the remainder of the contract period; and
WHEREAS, the outstanding invoices for engineering services requires an increase in the total contract amount of $29,590.00; and
WHEREAS, the requested increase in the total contract amount is deemed reasonable and necessary to pay the outstanding bills incurred during the contract period; and
WHEREAS, the increase of an additional Twenty Nine Thousand Five Hundred Ninety Dollars and Zero Cents ($29,590.00) brings the total contract to an amount not to exceed One Hundred Twenty Nine Thousand Five Hundred Ninety Dollars and Zero Cents ($129,590.00), for services provided from August 29, 2022 through August 28, 2023.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, are authorized on behalf of the City of Newark to execute an Amendment to the Agreement to provide Professional Engineering Services with Fastech Consulting, LLC d/b/a Fastech Consulting Engineers, 235 Moore Street, Hackensack, New Jersey 07601, for an additional Twenty Nine Thousand Five Hundred Ninety Dollars and Zero Cents ($29,590.00) for a period of May 20, 2023, through August 28, 2023, to cover the outstanding bills for a total contract not to exceed One Hundred Twenty-Nine Thousand Five hundred Ninety Dollars and Zero Cents ($129,590.00) and to correct the business entity name on the contract from Fastech Consulting Engineers to Fastech Consulting, LLC d/b/a Fastech Consulting Engineers.
2. The Municipal Council ratifies this Amendment to the Agreement to provide Professional Engineering Services from May 20, 2023 to the date of the adoption of this resolution.
3. All other terms and conditions of the contract shall remain the same.
4. Attached hereto is a Certificate of Funds from the Director of Finance of the City of Newark which states that there are sufficient funds, in the amount of Twenty Nine Thousand Five Hundred Ninety Dollars and Zero Cents ($29,590.00), from the Department of Water and Sewer Utilities/NW037-750-7502-71280-B2022 for the purpose set forth herein. The Certification of Funds shall be filed along with the original resolution in the Office of the City Clerk.
5. A copy of the executed Amendment to the Agreement to provide Professional Engineering Services shall be filed in the Office of the City Clerk by the Director of the Department of Water and Sewer Utilities and shall be made available for public inspection.
6. A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within ten (10) days of the adoption of this resolution.

This Resolution ratifies, amends and authorizes the Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities to enter into and execute an Amendment to the Agreement with Fastech Consulting, LLC d/b/a Fastech Consulting Engineers to provide Professional Engineering Services on an as needed basis services for an additional Twenty Nine Thousand Five Hundred Ninety Dollars and Zero Cents ($29,590.00) for a total contract amount not to exceed One Hundred Twenty-Nine Thousand Five Hundred Ninety Dollars and Zero Cents ($129,590.00) and correct the business entity name on the contract.
