                       WHEREAS, November 7, 2019, the City of Newark through its Purchasing Agent, QPA, advertised to solicit bids for contractor(s) to provide Tree Removal, Pruning, Root and Stump Removal Services to the Department of Public Works, Division of Sanitation, as per the bid proposal attached hereto; and 

 

                      WHEREAS, the Division of Central Purchasing published the bid package on the City of Newark’s website to provide broader access and download capability to potential bidders; and

 

 WHEREAS, the Division of Central Purchasing also distributed eight (8) bid proposal packages to prospective vendors following the date of advertisement; and

 

                     WHEREAS, one (1) vendor BJ’s Manicured Lawn Service was rejected for failure to provide the consent of surety for the performance bond; and   

 

WHEREAS, the Department of Public Works, Division of Sanitation recommended that a multiple award be made to: 1) Downes Tree Service Co. Inc., 65 Royal Avenue Hawthorne, New Jersey 07506; 2) Dujets Tree Experts Inc., 54 Notch Road, Woodland Park, New Jersey 07424; 3) Dom’s Lawnmaker Inc., 101 Harbor Road Port, Washington, New York 11050; 4) Ken’s Tree Care, 401 Paulding Avenue, Northvale, New Jersey 07647; 5) Millennium Tree Service, and Landscaping Design, Inc., 758 DeGraw Avenue Newark, New Jersey 07104; 6) Rich Tree Service Inc., 325 Bergen Street, South Plainfield, New Jersey 07080; and 7) Tree-Tech, Inc., P.O. Box 158, Mount Freedom, New Jersey 07970, as the lowest responsive and responsible bidders per line items and/or commodities; and

 

WHEREAS, the Purchasing Agent, QPA, recommends that a multiple award for the open competitive contracts for: a) Tree Diameter; b) Root and Stump Removal; and c)  Tree Pruning be made to: 1) Downes Tree Service Co. Inc., 65 Royal Avenue Hawthorne, New Jersey 07506; 2) Dujets Tree Experts Inc., 54 Notch Road, Woodland Park, New Jersey 07424; 3) Dom’s Lawnmaker Inc., 101 Harbor Road Port, Washington, New York 11050; 4) Ken’s Tree Care, 401 Paulding Avenue, Northvale, New Jersey 07647; 5) Millennium Tree Service and Landscaping Design, Inc., 758 DeGraw Avenue Newark, New Jersey 07104; 6) Rich Tree Service Inc., 325 Bergen Street, South Plainfield, New Jersey 07080; and 7) Tree-Tech, Inc., P.O. WHEREAS, the Purchasing Agent recommends the Set-Aside Contracts for: a) Tree Diameter; b) Root and Stump Removal; and c) Tree Pruning  be awarded  to Millennium Tree Service and Landscaping Design, Inc., 758 DeGraw Avenue, Newark, New Jersey 07104, the lowest responsive and responsible bidder to submit documentation by way of certification of MBE/WBE to establish their eligibility; and 

 

WHEREAS, pursuant to N.J.S.A. 40A: 11-24, the bidders consented to holding prices bid for consideration, until such time as an award is made, as the law permits; and

 

WHEREAS, pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A 40A: 11-1, et seq., meets the requirements of a fair and open process.

 

                      NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:  

 

1.                     The Mayor and/or his designee, the Purchasing Agent, QPA, are hereby authorized to enter into and execute open competitive contracts for: a) Tree Diameter; b) Root and Stump Removal; and c) Tree Pruning with: 1) Downes Tree Service Co. Inc., 65 Royal Avenue Hawthorne, New Jersey 07506; 2) Dujets Tree Experts Inc., 54 Notch Road, Woodland Park, New Jersey 07424; 3) Dom’s Lawnmaker Inc., 101 Harbor Road Port, Washington, New York 11050; 4) Ken’s Tree Care, 401 Paulding Avenue, Northvale, New Jersey 07647; 5) Rich Tree Service Inc., 325 Bergen Street, South Plainfield, New Jersey 07080; and 6) Tree-Tech, Inc., P.O. Box 158, Mount Freedom, New Jersey 07970, whose bids were received on the advertised due date and determined to be the lowest responsive and responsible bidders per line items in accordance with the bid specifications and enter into and execute  Set-Aside Contracts for: a) Tree Diameter; b) Root and Stump Removal; and c) Tree Pruning with: Millennium Tree Service and Landscaping Design, Inc., 758 Degraw Avenue, Newark, New Jersey 07104 the lowest responsive and responsible bidder submitted documentation by way of Certification of MBE/WBE establishing their eligibility. The terms of the contracts will be established for a period not to exceed period of twelve (12) consecutive months with a twelve (12) month option to renew, pursuant to N.J.S.A. 40A:11-15, at a cost not to exceed Two Million Dollars and Zero Cents ($2,000,000.00), for seven (7) vendors.

 

2.                     There shall be no amendment or change to the contracts without the approval of the Municipal Council by resolution.

 

3.                     There shall be no advance payments on the contracts in accordance with N.J.S.A. 40A:5-16. Funds for 2019 and subsequent years are contingent upon appropriations, pursuant to N.J.A.C. 5:30-5.5(d).

 

4.                     These are open-ended contracts to be used as needed during the term of the contract. Thus, for any and all expenditures against these contracts, a certification of the availability of sufficient funds, as required by N.J.A.C. 5:30-5.5(b)(2), shall be executed before a contractual liability is incurred each time an order is placed from: Account Code Lines, NW011-060-0603-71280-B2019, Department of Public Works, Division of Sanitation, the contract shall not exceed Two Million Dollars and Zero Cents ($2,000,000.00), for a period of twelve (12) consecutive months with a twelve (12) month option to renew.

 

5.                     Fully executed copies of the contracts shall be filed in the Office of the City Clerk by the Purchasing Agent, QPA.

 

6.                     If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract, to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller date May 7, 2008.

Box 158, Mount Freedom, New Jersey 07970, whose bids were received on the advertised due date and determined to be the lowest responsive and responsible bidders per line items in accordance with the bid specifications and enter into and execute  Set-Aside Contracts for: a) Tree Diameter; b) Root and Stump Removal; and c) Tree Pruning with: Millennium Tree Service and Landscaping Design, Inc., 758 DeGraw Avenue, Newark, New Jersey 07104 the lowest responsive and responsible bidder submitted documentation by way of Certification of MBE/WBE establishing their eligibility at a cost not to exceed Two Million Dollars and Zero Cents ($2,000,000.00), for a period of twelve (12) consecutive months with a twelve (12) month option to renew, for all seven (7) vendors.
