This Resolution ratifies and authorizes the City of Newark to request an extension from NJDOT to allow the City of Newark additional time to award a contract and secure additional funding for the Local Freight Impact Fund-19 Doremus Avenue Port Newark Connect project, extending the deadline from July 18, 2023 to January 18, 2024.

WHEREAS, the State of New Jersey Department of Transportation (“NJDOT”) State Aid to Counties and Municipalities, Local Freight Impact Fund (LFIF-19) provides grant funding for the improvement and construction of local, municipal, and county road and bridge projects; and
WHEREAS, on January 9, 2019, the Director of the Department of Engineering, on behalf of the City of Newark (the “City”), submitted LFIF-2019-Doremus Avenue Port Newark Connect-00042 application electronically to NJDOT requesting grant funding; and
WHEREAS, on February 13, 2019, the Municipal Council adopted Resolution 7R3-a(S) ratifying and authorizing the Director of the Department of Engineering to apply for, accept, and enter into grant documents for a grant award for LFIF-2019-Doremus Avenue Port Newark Connect-00042, NJDOT; and
WHEREAS, on July 18, 2019, NJDOT announced that the City was selected to receive a grant award in the amount of One Million Six Hundred Forty-Eight Thousand Five Hundred Thirteen Dollars and Zero Cents ($1,648,513.00), for the construction of LFIF-2019-Doremus Avenue Port Newark Connect-00042 (hereinafter the “Project”); and
WHEREAS, NJDOT required the City to bid and award the contract for construction of the Project, within thirty-six (36) months of the announcement of the receipt of a grant award, which fell on July 18, 2022; and
WHEREAS, due to COVID-19-related restrictions, limited staff, and NJDOT concerns that certain sidewalks of the Project are in close proximity to railroad tracks, the City was unable to secure the required permits necessary to go forward with the procurement process, resulting in a delay of the bid and award of the contract for the Project, on or before the July 18, 2022 deadline; and
WHEREAS, on June 2, 2022, the City filed for an extension of the deadline from July 18, 2022 to January 18, 2023; and
WHEREAS, on June 21, 2022, the Municipal Council adopted Resolution 7R4-a(as) authorizing the Extension Request from NJDOT; and
WHEREAS, on July 5, 2022, NJDOT approved the request of the City of Newark for an extension of the time from July 18, 2022 to January 18, 2023, for the award of the contract; and
WHEREAS, on October 4, 2023, the Municipal Council adopted Resolution 7R3-a, which authorized the City of Newark to accept the bid proposal submitted by Rockborn Trucking and Excavation Inc., 12 Taylor Road, Wharton, New Jersey 07885, and authorized the City to enter into and execute Contract #2022-04, LFIF-19 Doremus Avenue Newark Port for the total bid amount not to exceed Four Million Two Hundred Forty-Seven Thousand Nine Hundred Forty-Five Dollars ($4,247,945.00); and
WHEREAS, Rockborn Trucking and Excavation Inc.’s bid proposal exceeds the LFIF-19 grant received from NJDOT by Two Million Five Hundred Ninety-Nine Thousand Four Hundred Thirty-Two Dollars and Zero Cents ($2,599,432.00); and
WHEREAS, due to the need for additional time to develop the Two Million Five Hundred Ninety-Nine Thousand Four Hundred Thirty-Two Dollars and Zero Cents ($2,599,432.00) of funding for the project, the City wishes to request the third extension of the deadline from July 18, 2023 to January 18, 2024, to allow the City additional time to award a contract and secure additional funding for this project.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering are authorized to request an extension of the deadline from the New Jersey Department of Transportation (NJDOT), from July 18, 2023 to January 18, 2024, to allow the City additional time to award a contract and secure additional funding for the construction of LFIF-2019-Doremus Avenue Port Newark Connect-00042 project.
2. The Municipal Council hereby ratifies its authorization of this request from July 18, 2023 to the date of adoption of this authorizing Resolution.
3. All other terms and conditions of the grant award from the NJDOT for the LFIF-2019-Doremus Avenue Port Newark Connect-00042 project shall remain in force and effect until the contract is completed.
