AN ORDINANCE ESTABLISHING A SALARY FOR THE DEPARTMENT HEAD SERVING IN DUAL POSITION OF DIRECTOR OF WATER AND SEWER UTILITIES IN THE DEPARTMENT OF WATER AND SEWER UTILITIES AND INTERIM DIRECTOR OF PUBLIC WORKS IN THE DEPARTMENT OF PUBLIC WORKS

 

Body

 

WHEREAS, the Director of the Department of Water and Sewer Utilities has been serving in the additional position of Interim Director Department of Public Works in the Department of Public Works in an Interim capacity; and

 

WHEREAS, fair compensation for serving in the dual role and absorbing all the duties and responsibilities of the Department Head for the Department of Public Works justifies supplemental compensation until such time that he is no longer serving as Interim Director of Public Works and is relieved of those responsibilities; and

 

WHEREAS, such duties include the Director, through the Principal Public Works Manager, divisions and otherwise shall:  Be responsible for the proper and efficient conduct of all public works functions c the City government and shall provide advice and service to other departments as needed; Plan, organize, and direct the programs and activities of a comprehensive public works department, such as street repair and maintenance; servicing and maintenance of City owned motor vehicles; care and maintenance of City parks, grounds, shade trees; care and maintenance of public buildings; and collection and removal of street cleaning, refuse collection, snow removal and maintenance of vacant land owned by the City and private property neglected by private owners; Direct studies of public work functions; Administer and manage, through outside contracts, the demolition of structures which are hazardous to the health or safety of the citizens, where such has been duly authorized; Direct pothole repairs and snow removal on City streets; and Be responsible for the hiring, discipline, removal subordinate employees within the Department; and

 

WHEREAS, the Mayor recommends, and the governing body of the City of Newark concurs and designates, that the Director of the Department of Water and Sewer Utilities serve as Interim Director of the Department of Public Works during the transitional period and until such time that a duly appointed Director of the Department of Public Works is duly appointed. N.J.A.C. 4A:4-1.6 and N.J.S.A. 40A:9-9.

 

NOW THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY:

 

                     SECTION 1.                     An Ordinance establishing the salary for the Department Head serving in the duly appointed position of Director of Water and Sewer Utilities in the Department of Water and Sewer Utilities and as Interim Director in the position of Director of Public Works in the Department of Public Works as follows:

                     SECTION 2.                     The Director of the Department of Water and Sewer Utilities of the Department of Water and Sewer Utilities shall serve as the Interim Director of Public Works in the Department of Public Works until such time that a duly appointed Director Department of Public Works in the Department of Public Works is duly appointed.

 

                     SECTION 3. Nothing herein prohibits the establishment of the annual maximum/minimum salary of the duly appointed Director of the Department of Water and Sewer Utilities serving in such position as may be amended from time to time by general ordinances submitted by the Administration.

 

SECTION 4.   All prior ordinances or parts of prior ordinances which relate to the above positions, manner of appointments, titles, hours of employment, number of positions, or annual minimum and annual maximum salary therefore, which are inconsistent herewith, are hereby amended to be consistent to the extent it may be applicable to this ordinance.

 

SECTION 5.                     The hereinabove noted position is to be considered in the managerial or exempt class of positions with no standard hours of work. The incumbent employed in such position shall be subject to the responsibility for the completion of assigned duties and responsibilities and shall not be entitled to overtime compensation or to any accumulation of compensatory time. Where required for data processing purposes only, the hereinabove noted salary shall be calculated on a forty (40) hour work week.

 

                     SECTION 6.                     This ordinance shall take effect upon final passage and publication and in accordance with the laws of the State of New Jersey.

 

STATEMENT

 

This ordinance establishes supplemental salary for the Director of the Department of Water and Sewer Utilities for his role in serving as Interim Director of the Department of Public Works in the Department of Public Works and authority to serve as Interim Director.
