WHEREAS, Levin B. West, Sr. is the owner of property known as 46-48 Girard Place, Newark, New Jersey 07108 Block 3041, Lot 29; and
WHEREAS, on January 7, 2016, Levin B. West, Sr., through and by way of his Power of Attorney, Scheherazade West Forman, authorized Major John Sharpe James to obtain a Certificate of Code Compliance for 46-48 Girard Place, Newark, New Jersey, 07108, Block 3401, Lot 29.
WHEREAS, on January 8, 2016, Major John Sharpe James applied, and paid a fee in the amount of Two Hundred Fifty Dollars and Zero Cents ($250.00), to the City of Newark, Division of Inspections and Enforcement, for an inspection of 46-48 Girard Place, Newark, New Jersey 07108, Block 3041, Lot 29, for a Certificate of Code Compliance; and
WHEREAS, on January 14, 2016, prior to the performance of the inspection for a Certificate of Code Compliance of 46-48 Girard Place, Newark, New Jersey 07108, Block 3401, Lot 29, the inspection was cancelled; and
WHEREAS, the City of Newark, Division of Inspections and Enforcement, Certificate of Code Compliance Unit, did not inspect or render any services relating to 46-48 Girard Place, Newark, New Jersey 07108, Block 3041, Lot 29; and
WHEREAS, under these circumstances, the City is authorized to refund fees when no inspection occurred and no services were performed; and
WHEREAS, on February 3, 2016, Major John Sharpe James requested a refund in the amount of Two Hundred Fifty Dollars and Zero Cents ($250.00) for the fee paid to obtain an inspection for a Certificate of Code Compliance for 46-48 Girard Place, Newark, New Jersey 07108, Block 3041, Lot 29, as the inspection was not performed and is no longer required; and
WHEREAS, a refund in the amount of Two Hundred and Fifty Dollars and Zero Cents ($250.00) is now due and owing Major John Sharpe James, 6 Pomona Avenue, Newark, New Jersey 07112.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Director of City of Newark Department of Finance is hereby authorized to issue a refund check to Major John Sharpe James, 6 Pomona Avenue, Newark, New Jersey, 07112, in the amount of Two Hundred Fifty Dollars and Zero Cents ($250.00), as the inspection for the Certificate of Code Compliance for 46-48 Girard Place, Newark, New Jersey, 07108, Block 3041, Lot 29, was cancelled and the City did not render services in relation to said property.
2. Attached hereto is a Certification of Funds issued by the Director of the Department Finance of the City of Newark, which states that there are available sufficient, legally appropriated funds of Two Hundred Fifty Dollars and Zero Cents ($250.00) for the purpose set forth herein above and which states that the line appropriation of the office budget which shall be charged is the Business Unit: NW011, Department ID: 050, Division/Project: 0505, Account No.: 54120, Budget Reference: B2016.
3. The original Resolution shall be filed in the Office of the City Clerk by the Director of the Department of Neighborhood and Recreational Services.

This Resolution authorizes the Director of the Department of Finance to issue a check in the amount of Two Hundred Fifty Dollars and Zero Cents ($250.00) to Major John Sharpe James as a refund of the fee paid for a Certificate of Code Compliance inspection of 46-48 Girard Place, Newark, New Jersey, 07108, Block 3041, Lot 29, when the inspection was cancelled and the services were not performed.]
