Additional Information:

To provide Re-entry Training and Employment Pilot Program (Wrap-Around Social Services for formerly incarcerated individuals) with New Jersey Reentry Corporation (NJRC), a corporation of the State of New Jersey for education and rehabilitative services for recently released prisoners.

WHEREAS, the City of Newark (“City”) is a duly constituted municipal corporation at 920 Broad Street, Newark, New Jersey 07102; and

WHEREAS, N.J.S.A. 40A:11-5(1)(a)(i) empowers the Governing Body and its autonomous agencies to award contracts for Professional Services without competitive bidding; and

WHEREAS, the City is in need of Professional Services to manage the City’s reentry program for formerly incarcerated individuals who are provided employment through the City’s Department of Public Works; and

WHEREAS, the City is in receipt of a proposal from the New Jersey Reentry Corporation (“NJRC” or “Contractor”), headquartered at 591 Summit Avenue, Suite 605B, Jersey City, New Jersey 07306, to provide the requested professional services; and

WHEREAS, the NJRC is the only reentry program in Northern New Jersey New Jersey certified by the Department of Community Affairs; and

WHEREAS, the proposal submitted by the NJRC demonstrates that it has the requisite supervision, knowledge, education, skills, and experience to provide the requested professional services on behalf of the City, due to the depth of its experience with providing wrap-around social services to formerly incarcerated and court-involved individuals to remove barriers to employment, including, but not limited to: employment and training, legal services, transportation, linkage to housing, obtainment of identification, and linkage to medical behavioral, addiction treatment and mental health through Certified Community Behavioral Health Clinics, and medical care through Federally Qualified Health Centers; and

WHEREAS, fifty (50) formerly incarcerated and court-involved individuals in Newark, New Jersey (“Participants”) will receive wrap around social services from the NJRC and simultaneously receive six (6) months employment through the City’s Department of Public Works, and;

WHEREAS, the long term goal of the program will be to become a sustainable, outcome-based, cost-savings value program from which all Participants will benefit; and

WHEREAS, the City is interested in retaining the professional services of the NJRC for one (1) year from the period of June 15, 2021 through June 14, 2022, for an amount not to exceed One Hundred Ninety-Six Thousand Dollars and Zero Cents ($196,000.00) (the ”contract amount”); and

WHEREAS, the term of this appointment shall be for one (1) year, commencing on June 15, 2021 following the adoption of this Agreement by the Municipal Council. The term will include two (2) cohorts of fifty (50) Participants for six (6) months per cohort; and

WHEREAS, the City agrees to cover the cost/expense of three (3) NJRC employees who shall manage the City’s Department of Public Works Reentry Program, and such expense is included in the contract amount; and

WHEREAS, the NJRC shall provide the City with a New Jersey Business Registration Certificate; and

WHEREAS, the contract was not awarded through a Fair and Open Process as set forth at N.J.S.A. 19:44A-20.4 et seq. and there have not been any political contributions made to any representative of the City that would preclude the NJRC from providing the requested professional services.

                     NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1.                     The Corporation Counsel, on behalf of the City of Newark is hereby authorized to enter into and execute a contract with New Jersey Reentry Corporation (NJRC), a corporation of the State of New Jersey and in good standing at 591 Summit Avenue, Suite 605B, Jersey City, New Jersey 07306, to provide education and rehabilitative services for recently released prisoners in an amount not to exceed One Hundred Ninety-Six Thousand Dollars and Zero Cents ($196,000.00), for one (1) year from the period of June 15, 2021 through June 14, 2022.

2.                     Pursuant to N.J.A.C. 5:30-5(a), attached hereto is the Chief Finance Officer’s Certification, which states funds in the amount of One Hundred Twenty Thousand Dollars and Zero Cents ($120,000.00) are available in the 2021 Budget, Business Unit: NW051; Dept.: G21; Div./Proj.: ARPEO; Activity: A; Account #: 71280; Budget Ref.: B2021. The funds will be available in the 2021 Adopted Budget.  The Certification shall be filed, along with the original resolution and the executed contract in the Office of the City Clerk. 

3.                     The contract is awarded as a Non-Fair and Open Contract, pursuant to N.J.S.A. 19:44A-20.5; and the Business Entity has provided a statement that it is in compliance with the City of Newark, Contractor Pay to Play Ordinance, 2:4-22C.

4.                     The contract will contain language prohibiting any contributions in violation of any state or local law.

5.                     A copy of the executed agreement herein authorized shall be filed in the Office of the City Clerk and shall be made available for public inspection.

6.                     There shall be no amendments or changes to this contract without approval of the Municipal Council and there shall be no advance payments on this contract in accordance with N.J.S.A. 40A:5-16.
