      WHEREAS, on February 20, 2013, under Resolution 7R3-C, the Municipal Council authorized the Mayor and/or his designee the Business Administrator and the Deputy Mayor/Director of the Department of Economic & Housing Development to enter into a redevelopment grant agreement with Babyland Family Services, Inc. 755 South Orange Avenue, Newark, NJ 07106 in the amount of $150,000.00 for the purpose of performing physical rehabilitation to 767 South Orange Avenue, Block 4207, Lot 13,  West Ward;  and
      
WHEREAS, funds for the project were secured from the Strategic Housing and Redevelopment Project Enhancement Program Interest Accrual West Ward Allotment of $342,037.00; and
      
WHEREAS,  the Mayor and/or his designee, the Business Administrator and the Deputy Mayor/Director of the Department of Economic & Housing Development desire to amend Resolution 7R3-C 022013 to permit the Mayor and/or his designee the Business Administrator and the Deputy Mayor/Director of the Department of Economic & Housing Development to enter into and execute a First Amended Redevelopment Grant Agreement ("First Amendment"), in the form attached hereto, with Babyland Family Services, Inc., which shall increase the amount of the Agreement by $50,000.00, in order for the Grantee to complete the above physical rehabilitation; and term of the grant agreement shall be extended  to December 31, 2015; and
 
WHEREAS, the First Amendment shall not exceed $200,000.00 and shall be paid out of the Strategic Housing and Redevelopment Project Enhancement Program Interest Accrual West Ward Allotment; and
 
WHEREAS, the First Amendment is in compliance with the New Jersey Local Public Contracts Law, (N.J.S.A. 40:11-1 et seq.); and
 
WHEREAS, attached hereto is the Sponsorship Letter from the Honorable Councilman Joseph A. McCullum, Jr., Council Member representing the West Ward, approving funds for the project; and
 
WHEREAS, all other terms and conditions contained in contract 7R3C 022013 shall remain in full effect.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designees, the Business Administrator and the Director of the Department of Economic & Housing Development, are hereby ratified and authorized to enter into and execute a First Amended Redevelopment Grant Agreement ("First Amendment"), in the from attached hereto, with Babyland Family Services, Inc., 755 South Orange Avenue, Newark, NJ 07106, thereby increasing the contract amount by $50,000.00,  for a new total not to exceed $200,000.00 for the purpose of completing the physical rehabilitation to 767 South Orange Avenue, Newark, NJ  07106, located in the West Ward.
 
2.      The First Amended Grant Agreement contract period shall be extended to expire December 31, 2015
 
3.      This First Amendment is ratified from the Commencement Date, as defined in the Redevelopment Grant Agreement, until the date of adoption of this authorizing resolution.
 
4.      Attached hereto is a certification of funds from the Acting Director of Finance, which states (1) that there are sufficient funds in the amount of $50,000.00, for the purpose set forth hereinabove and (2) that the line appropriation of the official budget which shall be charged: Business Unit: NW051, Department: G09, Division/Project D19X0, Account: 72090, Budget Ref. B2009.
 
5.      The additional funds in the amount of $50,000.00 will be released in the form of a drawdown to Babyland Family Services, Inc., for the rehabilitation to 767 South Orange Avenue, Newark, NJ  07106.
 
6.      The Agreement complies with the New Jersey Local Public Contracts Law, (N.J.S.A. 40:11-1 et seq.).  
 
7.      The total amount of said grant agreement shall not exceed $200,000.00 and shall be paid from the Neighborhood Program West Ward accrued interest allotment approved under Resolution 7RCS(AS) 051706 and inserted into the City's budget under resolution 7R1-F 052009.
 
8.      A copy of this resolution and a fully executed First Amended Redevelopment Grant Agreement shall be filed with the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic & Housing Development.
 
9.      All other terms and conditions contained in Resolution 7R3-C022013 shall remain in full effect.
 
 
STATEMENT
 
Resolution ratifying and  authorizing the Mayor and/or his designees, the Business Administrator and the Deputy Mayor/Director of the Department of Economic & Housing Development on behalf of the Department of Administration to enter into and execute a First Amended Redevelopment Grant Agreement ("First Amendment") with Babyland Family Services, Inc., thereby increasing the contract amount by $50,000.00 for a new total not exceed to $200,000.00 for the purpose of completing the physical rehabilitation to 767 South Orange Avenue, Newark, NJ  07106.  The additional funds in the amount of $50,000.00 shall be secured from the Neighborhood Program West Ward interest accrual allotment approved under Resolution 7RCS(AS)051706 and extend the expiration date to December 31, 2015.
