This Resolution will rescind the contract due to American Asphalt and Milling Services, LLC failure to execute the contract.

WHEREAS, Resolution 7R1-e adopted on November 2, 2022, by Municipal Council of the City of Newark authorized the Mayor and/or his designee, the Business Administrator and/or the Qualified Purchasing Agent, to enter into and execute a contract with American Asphalt and Milling Services, LLC, 98 Midland Avenue, Kearny, New Jersey 07032 for the provision of Tandem Dump Trucks and Front End Bucket Loaders with Drivers in an amount not to exceed Three Hundred Fifty Thousand Dollars and Zero Cents ($350,000.00) for a period not to exceed twenty-four (24) consecutive months pursuant to N.J.S.A. 40A:11-15; and
WHEREAS, the Division of Central Purchasing mailed contract documents to American Asphalt and Milling Services, LLC in order to enter into aforementioned contract; and
WHEREAS, American Asphalt and Milling Services, LLC notified the Division of Central Purchasing that it is no longer able to hold its pricing for the bid which it submitted in 2020 due to price increases; and
WHEREAS, the City of Newark therefore wishes to rescind Resolution 7R1-e adopted on November 2, 2022 and the contract award.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council of the City of Newark hereby rescinds Resolution 7R1-e adopted on November 2, 2022 awarding a contract to American Asphalt and Milling Services, LLC98 Midland Avenue, Kearny, New Jersey 07032, to provide Tandem Dump Trucks and Front End Bucket Loaders with Drivers in an amount not to exceed Three Hundred Fifty Thousand Dollard and Zero Cents ($350,000.00) for a period not to exceed twenty-four (24) consecutive months.
Any authority to enter into and execute a contract pursuant thereto is null and void.
STATEMENT
This resolution rescinds Resolution 7R1-e adopted on November 2, 2022 which awarded a contract to American Asphalt, 96 Midland Avenue, Kearny, New Jersey 07032 for the provision of Tandem Dump Trucks Front End Bucket Loaders with Drivers in an amount not to exceed Three Hundred Fifty Thousand Dollars and Zero Cents ($350,000.00); for a period not to exceed twenty-four (24) consecutive months pursuant to N.J.S.A. 40A: 11-15.
