WHEREAS, over the years the City of Newark has entered into various grant agreements with the U.S. Department of Housing and Urban Development (HUD) for the receipt and expenditure of Community Development Block Grant (CDBG) funding; and
 
      WHEREAS, due to the importance of the services and programs funded in whole or in part by CDBG grant funds awarded to the City of Newark and performed or operated by local Sub-recipients for the benefit of the public, as well as the importance of utilizing HUD funding in a timely manner, the Mayor and the Business Administrator believe it is in the best interest of the City and the public who benefit from these services and programs, to reprogram unexpended CDBG funds for prior program years to satisfy the current needs of the public; and
      
WHEREAS, the City of Newark's Office of Partnerships and Grants Management proposed an amendment to its HUD one year Consolidated Plan for fiscal year 2014 by reprogramming unexpended CDBG funds from prior program year 2013, which has been approved by HUD; and
 
            WHEREAS, in consideration of current needs for the City as well as the services to be provided and the amount of reprogrammable funding available, the City of Newark believes it is in the best interest of the public and in conformity with applicable grant program guidelines, to award to the Housing Authority of the City of Newark, 500 Broad Street, Newark, New Jersey  07102, hereinafter the "Sub-recipient," a CDBG grant from reprogrammed funds in an amount not to exceed $432,873.00, to be used by the sub-recipient to perform physical rehabilitation services to 157-187 Chadwick Avenue and 189-215 Chadwick Avenue, Newark, New Jersey;  and
 
WHEREAS, in order to accomplish the foregoing, the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic & Housing Development desires to enter into an Agreement with the Sub-Recipient to provide CDBG funds in an amount not to exceed $432,873.00 for the contract period September 1, 2014 through August 31, 2015, to perform physical rehabilitation services to its facilities located at 157-187 and 189-215 Chadwick Avenue, Newark, NJ, which consists of the rehabilitation of 32 rental units into 42 rental apartments; and
 
WHEREAS, this Agreement is being awarded to the Housing Authority of the City of Newark, a non-profit organization and as such is not governed by State Pay-to-Play Law N.J.S.A. 19:44A-20.5; and  
 
WHEREAS, this Agreement is being awarded in compliance with the Community Development Block Grant Regulations, 24 CFR. 570.201.
 
            NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic & Housing Development are hereby authorized to enter into and execute an Sub-recipient Grant Agreement on behalf of the City of Newark with the Housing Authority of the City of Newark (hereinafter the "Sub-recipient"), 500 Broad Street, Newark, New Jersey  07102, for the period commencing on September 1, 2014 and terminating on August 31, 2015, to perform physical rehabilitation services to its facility located at 157-187 and 189-215 Chadwick Avenue, Newark, New Jersey, which consists of the rehabilitation of 32 rental units into 42 rental apartments as further described in the "Scope of Service" attached hereto.
 
2.      The Sub-recipient Grant Agreement between the City of Newark and the sub-recipient is hereby ratified from September 1, 2014 to the date of adoption of this authorizing resolution.
 
3.      The total amount of the grant awarded pursuant to the said Sub-recipient Grant Agreement shall not exceed $432,873.00 and shall be paid from reprogrammed CDBG funding approved by HUD.
 
4.      This contract is being awarded in compliance with the Community Development Block Grant Regulations, 24 CFR. 570.201.
 
5.      This Agreement is being awarded to a non-profit organization and as such is not governed by State Pay-to-Play Law N.J.S.A. 19:44A-20.5.
 
6.      Attached hereto is a Certification of Funds from the Acting Director of Finance for the City of Newark, which states (1) that there are sufficient funds for the purpose set for the hereinabove and (2) the line appropriation of the official budget which shall be charged is Business Unit: NW027; Department A13; Div/Project EX310; Account; 72090; Budget B2013.
 
7.      An executed copy of said Sub-recipient Grant Agreement shall be filed with the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic & Housing Development.
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic & Housing Development, to enter into a Sub-recipient Grant Agreement with the Housing Authority of the City of the City of Newark, 500 Broad Street, Newark, New Jersey 07102, utilizing reprogrammed CDBG funding approved by HUD, for the purpose of performing physical rehabilitation services to 157-187 Chadwick Avenue (aka 291-295 West Bigelow Street) and 189-215 Chadwick Avenue, Newark, New Jersey, for the period commencing on September 1, 2014 and terminating on August 31, 2015, in an amount not to exceed $432,873.00.
