WHEREAS, on September 11, 2018, the Municipal Council adopted Resolution 7R4-a(s/as) ratifying and authorizing the Mayor and/or his designee, the Director of the Department of Engineering, to apply for and accept grant funding from the Federal Highway Administration (FHWA), Federal Aid Program, administered by the State of New Jersey Department of Transportation (NJDOT), for the 2018 Safe Routes to Schools Program to provide for improvements that enable and encourage walking and bicycling to school, with no City funds required; and
WHEREAS, in response to the City’s application, on May 15, 2019 the New Jersey Department of Transportation announced the award of One Million Dollars and Zero Cents ($1,000,000.00) to the City of Newark for the 2018 Safe Routes to Schools Program; and
WHEREAS, on October 11, 2019 the New Jersey Department of Transportation announced the launch of a new Safe Routes to Schools Design Assistance Program, providing consultant engineering services to assist the City with development of plans, specifications and estimates (PS&E) for the 2018 Newark Safe Routes to School Program; and
WHEREAS, the City of Newark received a letter dated, October 27, 2020, from the New Jersey Department of Transportation informing the City that on September 23, 2020 the FHWA authorized funding in the amount of Three Hundred Ninety-Six Thousand Nine Hundred Dollars and Sixty Eight Cents ($396,900.68), without application, to the City of Newark Safe Routes to School project for Design Assistance Program for consultant engineering services for the 2018 Newark Safe Routes to School project, with no City funds required; and
WHEREAS, the Director of the Department of Engineering desires to accept the grant award and enter into a Cost Reimbursement Agreement 2021-DT-DLA-552, termed Federal Aid Agreement with New Jersey Department of Transportation, Division of Local Aid and Economic Development, for the City of Newark Safe Routes to School Project, TA-D00S(436); and
WHEREAS, as part of the Cost Reimbursement Agreement #2021-DT-DLA-552, all allowable costs incurred for the performance of work in the attached Scope of Work in the Cost Reimbursement Agreement shall be eligible for reimbursement from the effective date of November 15, 2020 and all such work shall be completed by November 15, 2023 for the City of Newark Safe Routes to School, TA D00S(436); and
WHEREAS, the City of Newark wishes to appoint the Mayor and/or his designee, the Director of the Department of Engineering, to act as the authorized person to execute this task Order Agreement #2021-DT-DLA-552 to accept the funds provided in the amount of Ninety-Six Thousand Nine Hundred Dollars and Sixty Eight Cents ($396,900.68) for the City of Newark Safe Routes to School Project, TA-D00S(436) under the Basic Agreement, dated November 15, 2020.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to accept grant funding in the amount of Ninety-Six Thousand Nine Hundred Dollars and Sixty Eight Cents ($396,900.68) for consultant engineering services for the 2018 Newark Safe Routes to School project, with no City funds required.
2. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to enter into and execute a Cost Reimbursement Agreement #2021-DT-DLS-552, for the City of Newark Safe Routes to School Project, TA-D00S(436), to receive and expend the above grant award for consultant engineering services as per terms and conditions of the Cost Reimbursement Agreement between the City of Newark and the New Jersey Department of Transportation.
3. The Cost Reimbursement Agreement #2021-DT-DLA-552 is ratified from the date of the award on October 27, 2020 until the date of adoption of this resolution.
4. No municipal funds are required for receipt or acceptance of this award.
5. The Director of the Department of Engineering shall file a copy of the award letter and a fully executed copy of the Cost Reimbursement Agreement #2021-DT-DLA-552 in the Office of the City Clerk.
STATEMENT
This resolution ratifies and authorizes the Mayor and his/her designee, the Director of the Department of Engineering, to enter into and execute a Cost Reimbursement Agreement 2021-DT-DLA-552, for the City of Newark Safe Routes to School Project, TA-D00S(436), with the New Jersey Department of Transportation and accept funds provided in the amount of $396,900.68, for the City of Newark Safe Routes to School Project, TA-D00s(436), as per terms and condition of the Cost Reimbursement Agreement.
