 WHEREAS, on or about April 26, 2017, and pursuant to Newark, New Jersey Municipal Code Article 4, §2:5-13.2e.1, the City of Newark (hereinafter referred to as “City”) entered into Emergency Contract # E-2017-10 with contractors EnviroScience Solutions LLC, 28 North Day Street, Orange, New Jersey 07050, Optimum Environmental Solutions LLC, 2717 Linwood Road, Union, New Jersey 07083, and Turningpoint Contracting Corporation, 51 Berkeley Terrace, 1st Floor, Irvington, New Jersey 07111 (hereinafter collectively referred to as “Contractors”) for the provision of lead hazard control and reduction services and healthy homes production, from April 24, 2017 through July 21, 2017, in an amount not to exceed $450,000.00; (a copy of said Emergency Contract # E-2017-10 is attached hereto and made a part hereof); and

    

WHEREAS, on December 20, 2016, a Lead Hazard Control and Reduction Services & Healthy Homes Production (Contractor) services bid with a return date of January 12, 2017, was advertised for the same services; and

 

WHEREAS, on August 2, 2017, the Municipal Council adopted Resolution 7R1-f (attached hereto) which authorizes the Mayor and/or his designee, the Supervising Procurement Specialist, QPA, to enter into and award to nine (9) vendors this aforementioned contract that shall commence on August 15, 2017, and shall have a two-year term; and

 

 

 

WHEREAS, since services were provided under the Emergency Contract from April 24, 2017 through July 21, 2017, in order to fill the gap while the contract’s execution is pending, this Emergency Contract is necessary; and

 

WHEREAS, the Department of Health and Community Wellness is in immediate and emergent need for Contractors to continue to provide Lead Abatement services for the period of July 22, 2017 through August 14, 2017, the date which the Municipal Council authorized the contract to commence; and

 

WHEREAS, N.J.S.A. 40A:11-6 provides that emergency contracts may be entered into when an emergency affecting the public health, safety or welfare requires the immediate delivery of goods or the performance of services; and

 

WHEREAS, Newark, New Jersey Municipal Code Article 4, §2:5-13.2e.1(c) provides that no extension of an emergency contract shall be permitted without authorization by the Municipal Council by resolution; and

 

WHEREAS, the Department of Health and Community Wellness desires to extend Emergency Contract # E-2017-10 for the period of July 22, 2017 through August 14, 2017, the date which the Municipal Council authorized the contract for said services to commence; no additional funds are required for the emergency extension period; and

 

WHEREAS, the State Department of Community Affairs has approved the above-described extension of the Emergency Contract (a copy of the State Department of Community Affairs Waiver is attached hereto).

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to extend Emergency Contract # E2017-10 with EnviroScience Solutions, LLC, 28 North Day Street, Orange, New Jersey 07050, Optimum Environmental Solutions LLC, 2717 Linwood Road, Union, New Jersey 07083 and Turningpoint Contracting Corporation, 51 Berkeley Terrace, 1st Floor, Irvington, New Jersey 07111, to provide at no additional cost to the City lead abatement services to City residents for the period of July 22, 2017 through August 14, 2017, the date which the Municipal Council authorized the contract for said services to commence.

 

2.                     The above-described extension of Emergency Contract # E2010-10 is hereby ratified from July 22, 2017, to the date of adoption of this authorizing resolution.

 

3.                     No additional funds are required for the emergency extension period.

 

4.                     Copies of this resolution and the above-described extended Emergency Contract shall be filed with the Office of the City Clerk, by the Director of the Department of Health and Community Wellness.

 

STATEMENT

 

This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Health and Community Wellness, to extend Emergency Contract # E2017-10 with EnviroScience Solutions, LLC,  Optimum Environmental Solutions LLC,  and Turningpoint Contracting  for the provision of lead hazard control and reduction services and healthy homes services, for the period of July 22, 2017 through October 21, 2017,  no additional funds are needed for the extension period.
