WHEREAS, on July 16, 2025, the City of Newark through its Qualified Purchasing Agent(“Purchasing Agent”) advertised to solicit bids for contractors to provide police motorcycles for the Department of Public Safety/Division of Police, as described in the attached bid proposal; and
WHEREAS, the Division of Central Purchasing also published the bid package on the City of Newark’s website to provide a broader access; and download capability to potential bidders; and
WHEREAS, on July 31, 2025, the Division of Central Purchasing received Zero (0) bids for this solicitation; and
WHEREAS, on August 15, 2025, the City of Newark through its Purchasing Agent, advertised to resolicit bids for contractors to provide police motorcycles for the Department of Public Safety/Division of Police, as described in the attached bid proposal; and
WHEREAS, the Division of Central Purchasing also published the bid package on the City of Newark’s website to provide a broader access; and download capability to potential bidders; and
WHEREAS, by way of the electronic procurement portal, ten (10) bid proposal packages were downloaded by prospective vendors following the date of advertisement; and
WHEREAS, on August 29, 2025, the Division of Central Purchasing received Three (3) bids for this re-solicitation; (1) Bergen County Harley Davidson, 124 Essex Street, Rochelle Park, New Jersey 07662; (2) Cross County BMW, 875 Middlesex Avenue, Metuchen, New Jersey 08840 and (3) Hannum’s Mt. Holly DBA Liberty Harley-Davison, 12 West Milton Avenue, Rahway, New Jersey, 07065; and
WHEREAS, two bids were deemed non-responsive; vendors were unable to meet the required specification as indicated in the bid proposal; and
WHEREAS, On September 9, 2025, the Director of the Department of Public Works recommended that a single award be made to: Bergen County Harley Davidson, 124 Essex Street, Rochelle Park, New Jersey 07662, being the overall responsive and responsible bidder; and
WHEREAS, after the review of the bids received and the recommendation provided by the Director of the Department Public Safety, the Purchasing Agent, the recommends that the Municipal Council make the award to: Bergen County Harley Davidson, 124 Essex Street, Rochelle Park, New Jersey 07662, based on the recommendation of the Director of the Department of Public Safety; and
WHEREAS, pursuant to N.J.S.A. 40A:11-24, the recommended bidder consented to holding their prices bid for consideration, until such time as an award is made, as the law permits; and
WHEREAS, pursuant to N.J.S.A. 19:44A20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1 et seq. meets the requirements of the Fair and Open Process
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and /or his designee, the Business Administrator and the Qualified Purchasing Agent (“Purchasing Agent”), are hereby authorized to enter into and execute a contract with Bergen County Harley Davidson, 124 Essex Street, Rochelle Park, New Jersey 07662 to provide police motorcycles for the City of Newark, Department of Public Safety/Division of Police, whose bid was received on the advertised due date and determined by the Director of Public Safety to be the overall responsive and responsible bidder in accordance with the bid specifications. For the one-time purchase and delivery of Police Motorcycles. The term of the contract will be established for a term not to exceed the purchase completion period required upon Municipal Council Approval.
2. There shall be no amendments or changes of this Resolution without the approval of the Municipal Council by resolution.
3. There shall be no advance payments on this Contract in accordance with N.J.S.A. 40A:5-16.
4. The Purchasing Agent shall file a duly executed copy of the contract in the Office of the City Clerk, if applicable.
5. If required by State Law, the Acting City Clerk shall provide the appropriate Notice of Award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated July 1, 2025.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Business Administrator, and the Qualified Purchasing Agent, to enter into and execute contract with Bergen County Harley Davidson, 124 Essex Street, Rochelle Park, New Jersey 07662 to provide a one-time purchase of Police Motorcycles for the City’s Department of Public Safety/Division of Police, at a cost not to exceed Four Hundred Thirty-Five Thousand Dollars and Zero Cents ($435,000.00) upon purchase and delivery for a period to be determined upon Municipal Council approval, the purchase date commencing upon contract execution.
