WHEREAS, on February 23, 2021, the Municipal Council of Belleville, New Jersey adopted a Resolution authorizing the execution of a contract with the City of Newark for the supply of potable water for the period of August 1, 2020 through July 31, 2030; and

 

WHEREAS, Resolution 7R12-a, adopted by the City of Newark Municipal Council on May 5, 2021, authorized the Director of the City of Newark’s Department of Water and Sewer Utilities to enter into and execute a contract with the Township of Belleville for the supply of potable water for the period of August 1, 2020 through July 31, 2030; and

 

WHEREAS, the City of Newark and the Township of Belleville entered into a contract, dated February 23, 2021, for the supply of potable water by the City of Newark to the Township of Belleville for the period of August 1, 2020 through July 31, 2030; and

 

WHEREAS, the Parties desire to enter into this Amendment No. 1 to the February 23, 2021 Water Contract Between the Township of Belleville and the City of Newark, at the request of the Township of Belleville, to increase the amount of water supplied by the City of Newark from 4.2 MGD (four million, two hundred thousand gallons per day) to 6.0 MGD (six million gallons per day) (Township of Belleville Resolution #221-2026 adopted July 1, 2026 is attached; and

 

WHEREAS, Newark has available water and the capacity and is able to supply water to Belleville in the requested amount of six million gallons per day (6.0 MGD), one hundred eighty-two million, five hundred thousand gallons per month (182.5 MGM) or two billion one hundred ninety million gallons per year (2,190 MGY).

 

NOW THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee the Director of the Department of Water and Sewer Utilities are authorized to execute Amendment No. 1 to the February 23, 2021 Water Contract Between the Township of Belleville and the City of Newark increasing the amount of water supplied by the City of Newark from 4.2 MGD (four million, two hundred thousand gallons per day) to 6.0 MGD (six million gallons per day, one hundred eighty-two million, five hundred thousand gallons per month (182.5 MGM) or two billion one hundred ninety million gallons per year (2,190 MGY) and as more fully set forth in Amendment No. 1.

 

2.                     This Amendment shall take effect on August 1, 2026 and continue to July 31, 2030.

 

3.                     All other terms and conditions of the Agreement remain the same.

 

STATEMENT

 Resolution amending, ratifying and authorizing the Mayor and/or the Director of the Department of Water and Sewer Utilities to execute Amendment No.1 to the February 23, 2021 Water Contract Between the Township of Belleville and the City of Newark increasing the amount of water supplied by the City of Newark.
