WHEREAS, the United States Department of Justice ("USDOJ") has made funds available through its Second Chance Adult and Juvenile Offender Re-entry Demonstration Program ("Second Chance Re-entry Projects"), which encouraged cities to develop community-based strategies to reduce crime, violence and recidivism by fifty percent (50%) within a five (5) year period; and
 
WHEREAS, the City of Newark, Office of Re-entry of the Department of Economic and Housing Development ("DEHD") in conjunction with the Office of the Business Administrator, authorized by Resolution 7R3-A, adopted March 2, 2011, prepared a proposal and application to USDOJ for the Newark Crime Prevention and Recidivism Reduction Initiative ("NCPRRI"); and
 
WHEREAS, the USDOJ awarded the City a $750,000.00 grant for these services and has approved a budget that includes expenditures of $684,225.00 for Case Management, Job Placement, and Transitional Employment Services for 150 young adults, ages 18-30; and
 
WHEREAS, pursuant to Resolution 7R3-A, adopted March 2, 2011, the City accepted grant funds and entered into a grant agreement with USDOJ, for the grant award 2010-CZ-BX-0060, in the amount of $750,000.00, for the NCPRRI, for the period commencing on October 1, 2010 and terminating on September 30, 2011; and
 
WHEREAS, the term for the above grant agreement was subsequently amended through Resolution 7R1-A110711, Resolution 7R3-D060712 and Resolution 7R3-A 032013, for the currently amended term of October 1, 2010 through December 31, 2013; and
 
WHEREAS, the DEHD used said funds to enter into performance-based contracts with vendors to hold them accountable for outcomes; and
 
WHEREAS, not all vendors met their performance benchmarks and some funds remain available; and
 
WHEREAS, the Business Administrator requested an extension of the expiration date for the grant agreement from December 31, 2013 to December 31, 2014, through the submission of a Grant Adjustment Notice to USDOJ, which was approved by USDOJ on February 6, 2014; and
 
WHEREAS, the DEHD seeks to amend the grant agreement to extend the grant term from October 1, 2010 through December 31, 2013 to October 1, 2010 through December 31, 2014.
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The term of the grant agreement (2010-CZ-BX-0060) between the USDOJ and the City of Newark, Office of Re-entry of the Department of Economic and Housing Development is hereby amended from October 1, 2010 through December 31, 2013 to October 1, 2010 through December 31, 2014.
 
2.      The amended grant agreement is hereby ratified from December 31, 2013 to the date of adoption of this authorizing resolution.
 
3.      The Mayor and/or his designee, the Director of the Department of Economic and Housing Development, are hereby authorized to execute any grant documents necessary to effectuate this amendment.  A copy of the USDOJ Grant Adjustment Notice approving the grant extension is hereby attached.
 
4.      No municipal funds are required for the effectuation of this grant extension.
 
5.      This resolution, the USDOJ Grant Adjustment Notice and the amended grant agreement shall be filed with the Office of the City Clerk by the Director of the Department of Economic and Housing Development.
 
6.      All other terms and conditions contained in the Agreements authorized pursuant to Resolutions 7R3-A030211, 7R1-A110711, 7R3-D 060712 and 7R3-A 302013 shall remain in full effect and accordance with the law.
 
 
STATEMENT:
 
This resolution hereby amends, ratifies and authorizes the Mayor and/or his designee, the Business Administrator to submit a Grant Adjustment Notice to the USDOJ requesting an additional amendment to the grant agreement extending the expiration date from December 31, 2013 to December 31, 2014.  This resolution further authorizes the Mayor and/or his designee, the Director of the Department of Economic and Housing Development to enter into and execute any amended grant documents necessary to effectuate this amendment to extend the grant term from October 1, 2010 through December 31, 2013 to October 1, 2010 through December 31, 2014 for the grant award No. 2010-CZ-BX-0060.
