WHEREAS, John Holley wishes to provide a gift of Two Hundred Dollars and Zero Cents ($200.00) to residents of the City of Newark, for the purpose of providing access to John F. Kennedy Aquatic Center, through the Department of Recreation, Cultural Affairs and Senior Services’ Community Pass Program; and

 

WHEREAS, the Community Pass Program has a fee of Five Dollars and Zero Cents ($5.00) per person for Newark residents; and

 

WHEREAS, pursuant to Local Public Contracts Law, N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies and gifts made to it and is empowered to utilize such bequests, legacies and gifts in the manner set forth in the conditions of the bequest, legacy or gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of America; and

 

WHEREAS, John Holley fully understands and agrees that he is not entitled to receive any direct benefit from the City of Newark in exchange for his gift; and

 

WHEREAS, the City of Newark, Department of Recreation, Cultural Affairs and Senior Services, Division of Recreation, desires to accept the gift of Two Hundred Dollars and Zero Cents ($200.00), in support of City of Newark residents having access to John F. Kennedy Aquatic Center through the Community Pass program, pursuant to N.J.S.A. 40A:5-29.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services, are hereby authorized to accept a gift of Two Hundred Dollars and Zero Cents ($200.00) from John Holley, 5 Manor Drive, Newark, New Jersey 07106, in support of City of Newark residents having access to John F. Kennedy Aquatic Center through the Community Pass Program.

 

2.                     No municipal funds will be expended in the acceptance of this gift.

 

3.                      A copy of the gift money order shall be filed in the Office of the City Clerk by the Director of Recreation, Cultural Affairs and Senior Services.

 

 

STATEMENT

 

This resolution authorizes the Mayor and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services, to accept a gift of Two Hundred Dollars and Zero Cents ($200.00) from John Holley, 5 Manor Drive, Newark, New Jersey 07106, in support of City of Newark residents having access to John F. Kennedy Aquatic Center through the Community Pass Program. No municipal funds are required.
