AN ORDINANCE AUTHORIZING THE CANCELLATION OF TAXES, INTEREST, AND PENALTIES FOR YEARS 2010 THRU 2013, ON PROPERTY OWNED BY UNITED COMMUNITY CORPORATION LOCATED AT 31-33 FULTON STREET, BEING BLOCK 15, LOT 28

WHEREAS, U.C.C. Realty Holding Corp., Inc. is a New Jersey Corporation Organized under Title 15A of the New Jersey Statutes, as a non-profit corporation; and
WHEREAS, U.C.C. Realty Holding Corp., Inc. is the owner of property located at 31-33 Fulton Street, being Block 15 Lot 28; and
WHEREAS, the property was removed from the exempt list of the City of Newark in 2011 and subsequently billed omitted added taxes for year 2010 and added assessment taxes for 2011; and
WHEREAS, the property would have qualified for Exemption from property taxation under N.J.S.A. 54:4-3.6, had the property owners filed a timely application for said exemption; and
WHEREAS, Pursuant to N.J.S.A. 54:4-3.6c, a showing of good cause has been made as to why a timely application for exemption was not filed; and
WHEREAS, the Tax Assessor requests that the exemption be granted for the years 2010 to 2013 (Certification attached hereto);
NOW THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. By copy of this Ordinance, the Tax Assessor of the City of Newark is hereby authorized to remove the tax assessments for years 2010, 2011, 2012, 2013 on the property owned by U.C.C. Realty Holding Corp., Inc., located at 31-33 Fulton Street, being Block 15 Lot 28.
2. By copy of this Ordinance, the Tax Collector of the City of Newark is hereby authorized to cancel the taxes for the full years of 2010, 2011, 2012, and 2013 plus interest, penalties and costs on the property owned by U.C.C. Realty Holding Corp., Inc., located at 31-33 Fulton Street, Block 15 Lot 28.
