AN ORDINANCE AMENDING 6PSF-I ADOPTED ON AUGUST 2, 2023, TITLE XIX, RENT CONTROL, CHAPTER 2, RENT CONTROL REGULATIONS; RENT CONTROL BOARD, OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, 2000, AS AMENDED AND SUPPLEMENTED, BY MAKING VARIOUS CORRECTIONS.

WHEREAS, the Municipal Council of the City of Newark (the "City") adopted Ordinance 6PSF-i on August 2, 2023, making various amendments to the Title XIX, Chapter 2; and

WHEREAS, it is necessary to amend Ordinance 6PSF-I adopted August 2, 2023, to make various corrections; and

WHEREAS, it is necessary to define the position of Rent Regulation Officer and establish the powers inherent with this office.

WHEREAS, it is appropriate and necessary to define the powers of the Rent Control Board and provide the Rent Control Board with equitable powers to assist in carrying out and executing the provisions of the Rent Control Ordinance as fairness requires; and

WHEREAS, it is appropriate and necessary to broaden the definition of exemptions to encompass the legislative intent of the State of New Jersey regarding the construction of new multiple unit residential dwellings; and

WHEREAS, it is appropriate to establish procedures, so as to permit landlords to file applications for rent control exemptions upon issuance of a Temporary Certificate of Occupancy; and

WHEREAS, it is appropriate and necessary to require landlords to provide notice of rent increases to tenants and the Rent Control Board; and

WHEREAS, it is appropriate and necessary to set time restrictions for purposes of rent rebates which may be due to tenants; and

WHEREAS, it is appropriate and necessary to conform the requirements for exemption claims for vacant properties to the requirements of applications for substantial rehabilitations; and
