WHEREAS, pursuant to N.J.S.A. 40A:9-120 et seq., the City of Newark is authorized to appoint up to fifty (50) Constables to establish the term for such appointment at one (1) or three (3) years; and
WHEREAS, the City of Newark wishes to appoint Heberto Anthony Canon, as a Constable, for a three (3) year term. N.J.S.A. 40A:9-121.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Heberto Anthony Canon, 23 Chester Avenue, Newark, New Jersey 07104, is hereby appointed as a Constable, in accordance with his application to serve legal papers and help the community.
2. Prior to entering upon the execution of his office and no later than thirty (30) days after the effective date of the appointment, the aforesaid appointee shall submit a Constable Bond, which shall be approved as to form, amount, and sufficiency of Surety by resolution of the Newark Municipal Council.
3. This appointment shall be for a period of three (3) years from the date of the appointment or to the expiration of the Constable Bond, whichever occurs first.
