AN ORDINANCE OF THE CITY OF NEWARK AMENDING CHAPTER 2:24-1.4 RESIDENCY BY ESTABLISHING A NONRESIDENT EXEMPTION LIST FOR THE APPOINTMENT OF CERTAIN SPECIAL LAW ENFORCEMENT OFFICERS.

WHEREAS, the Municipal Council of the City of Newark, New Jersey has established a requirement that all Special Law Enforcement Officers be a resident of the City of Newark; and
WHEREAS, at the time of the establishment of this requirement there was a list of Special Law Enforcement Officers that were not residents of the City of Newark seeking reappointment, which the Council did not feel should have to comply with this new residency requirement; and
WHEREAS, the ordinance establishing the new residency requirement provided an exemption for these Special Law Enforcement Officers; and
WHEREAS, it is the position of the Municipal Council that no additional names be added to the 2012 list of Special Law Enforcement Officers that were not residents of the City of Newark at that time; and
WHEREAS, by state statute, Regular Police Officers in a Civil Service jurisdiction, are not required to be residents of the municipality in which they work; and
WHEREAS, the residency requirement in the City of Newark revised ordinances for Special Law Enforcement Officers will prevent a Police Officer who retires from the City of Newark Police Department and seeks employment as a Special Law Enforcement Officer from being appointed as a Special Law Enforcement Officer; and
WHEREAS, the 2013 list of individuals to be appointed as Special Law Enforcement Officers that are not residents of the City of Newark includes additional names not listed in 2012 as a result of the appointment of retired Newark Police Officers.
NOW HEREFORE BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
