WHEREAS, permission is required of the Director of the Division of Local Government Services for approval as a dedication by rider of revenues received by a municipality when the revenue is not subject to reasonably accurate estimates in advance; and

WHEREAS, Title 29, Streets and Sidewalks, Chapter 28, Use of Streets for Telecommunications; Fees, within the Newark Municipal Code, adopted on August 5, 2020, through Ordinance 6PSF-d, provides that the Director of the Department of Finance shall place all telecommunications fees received for the City's Small Cell Wireless and Wireline Facilities (5G) into a separate account; and

WHEREAS, N.J.S.A.40A:4-39 provides that the Director of the Division of Local Government Services may approve expenditures or moneys by dedication by rider.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Municipal Council of the City of Newark, New Jersey hereby requests the permission of the Director of Local Government of the State of New Jersey under the provisions of N.J.S.A.40A:4-39, of revenues received under Title 29, Streets and Sidewalks, Chapter 28, Use of Streets for Telecommunications; Fees, of the Newark Municipal Code, adopted on August 5, 2020 through Ordinance 6PSF-d, for the exclusive purpose of depositing and expending funds paid the City to offset the City's reasonable costs of ...
