AN ORDINANCE AMENDING TITLE 23, TRAFFIC AND PARKING, CHAPTER 4, LIMITING USE OF STREETS TO CERTAIN VEHICLES, OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, BY ADDING SECTION 23:4-1.2, TRUCK ROUTE FOR OVERWEIGHT VEHICLES.

WHEREAS, the Department of Engineering of the City of Newark, seeks to encourage the movement of international waterborne freight moving through the seaport in Port Newark by designating Doremus Avenue, between Port Street and Route 1 & 9 Truck Route, as an overweight corridor. This corridor would encourage the development of warehouses and distribution centers in support of ocean borne containerized cargo moving in shipping containers in excess of the 80,000 pound maximum gross vehicle weight (MGVW) limit which exists through much of New Jersey; and
WHEREAS, by instituting a 128,000 pound MGVW limit on Doremus Avenue, which is consistent with the limit in the adjacent seaport, gives the City of Newark an advantage to redevelop sites in the area; and
WHEREAS, the ordinance shall provide that the Gross Vehicle Weight of containerized shipments (tractor, chassis, container, cargo, etc.) shall not exceed 128,000 pounds and shall not exceed manufacturer safe working loads.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
Section 1. That Section 23:4, Limiting Use of Streets to Certain Vehicles, of Title 23, Traffic and Parking, of the General Revised Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, be amended by adding the following:
23:4-1.2 Truck Route for Overweight Vehicles.
Any trucks in excess of the 80,000 pound maximum gross vehicle weight (MGVW), but a maximum not exceed 128,000 pound maximum gross vehicle weight (MGVW), may utilize those streets listed which form a part of the Truck Routes for Overweight Vehicles.
