WHEREAS, PAR Energy Group LLC, 37 Battle Ridge Trail Totowa, New Jersey, 07512, submitted an application to the Uniform Construction Code Office (the "UCC Office") dated October 19, 2017, for Construction Permits to perform building protection work for the property located at 62-64 Elizabeth Avenue, Newark, New Jersey 07108. PAR Energy Group LLC, paid a relevant fee in the amount of $403.00 (which consisted of Plan Review Fees and Construction Permit Fees) as per attached Construction Permit Document relating to Permit Number #17-CP-003212; and
WHEREAS, the permit for the construction, specifically, Permit Number #17-CP-003212, for 62-64 Elizabeth Avenue, Newark, New Jersey 07108, Block 2793, Lot 1, was voided by the Construction Official because the wrong sized underground oil tank was removed due to detecting other metal readings. PAR Energy Group, LLC, made a timely application to the UCC Office for a refund of the fees paid; and
WHEREAS, it is the determination of the Construction Official of the City of Newark, that the permit issued to and paid for by PAR Energy Group LLC, is voidable and a refund in the amount of $322.00 (20% of the total Construction Permit Fee, $81.00, is withheld for Plan Review Services), against Permit Number #17-CP-003212, dated October 19, 2017 may be issued.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
