WHEREAS, the City of Newark, 920 Broad Street, Newark, New Jersey, 07102 (the "City") owns property located at Paterson Hamburg Turnpike at Canistear Road, Stockholm, New Jersey, designated as Block 566.02, Lot 1; and
WHEREAS, the New Jersey Department of Transportation ("State" or "NJDOT") intends to reconstruct and improve the Route 23 Northbound Bridge over Pequannock River located in Stockholm, Passaic County (hereinafter called the "Project"); and
WHEREAS, in the attached NJDOT documents the State identified and refers to the property as Route 23, Section 5, Parcel E84; and
WHEREAS, the Project requires a Temporary Construction Easement Agreement for a property located at Paterson Hamburg Turnpike at Canistear Road, Stockholm, New Jersey, which is owned by the City; and
