AN ORDINANCE DENYING THE FIVE (5) YEAR TAX ABATEMENT APPLICATION FOR THE OWNER OF THE RESIDENTIAL STRUCTURE LOCATED AT 545 N. 7TH STREET, BLOCK 595 LOT 12.01 AND IDENTIFIED IN THE ATTACHED EXHIBIT A, BASED UPON THE OWNER'S FAILURE TO SUBMIT REQUIRED DOCUMENTS WITHIN THE THIRTY (30) DAY TIME PERIOD.

WHEREAS, the respective owner ("the owner") of the residential structure more specifically identified as 545 N. 7th Street, Block 595, Lot 12.01 in the attached Exhibit A ("the residential structure"), caused to be filed with the City of Newark Five-Year Tax Abatement Application ("the application"), pursuant to N.J.S.A. 54:4-3.139 et seq. and the Revised Ordinances of the City of Newark (R.O. 10:26-1, et seq., as amended); and

WHEREAS, a tax abatement pursuant to N.J.S.A. 54:4-3.139, et seq. and the Revised Ordinances of the City of Newark (R.O. 10:26-1, et seq., as amended) provides for a five (5) year tax abatement for new residential construction in order to reduce the substantially high tax burdens and to stabilize and maintain the viability of the neighborhood; and

WHEREAS, the Office of Assessment's procedure for
processing applications is that upon receipt of an application the owner is provided with notice ("the notice") indicating which document(s) the owner must submit to the Office of Assessment to complete the application and the time period within which the Office of Assessment must receive the document(s); and

WHEREAS, the Office of Assessment gives the
Owner 30 days within which to submit the required document(s); and

WHEREAS, the notice also indicates that if the
required document(s) are not received by the Office of Assessment within 30 days an ordinance will be sent to the Municipal Council recommending denial of the application and, if approved, the property will be placed on the regular tax rolls; and
