AN ORDINANCE TO RESCIND RESOLUTION 7RBC ADOPTED ON OCTOBER 6, 2004, THUS DE-DESIGNATING THE HOUSING AUTHORITY OF THE CITY OF NEWARK AS THE REDEVELOPMENT ENTITY FOR THE NEWARK DOWNTOWN CORE DISTRICT REDEVELOPMENT AREA.

WHEREAS, on July 14, 2004, the City utilized the powers of Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1 et seq. to designate over 39 acres of land within the Downtown Newark area as an "area in need of redevelopment," commonly known as the Newark Downtown Core District Redevelopment Area; and
WHEREAS, on October 6, 2004, the Municipal Council adopted Ordinance 6S&FF adopting the Newark Downtown Core District Redevelopment Plan ("Plan") and adopted Resolution 7RBC appointing the Housing Authority of the City of Newark ("Authority") as the City's Redevelopment Entity for the purpose of implementing the Plan on behalf of the City in accordance with N.J.S.A. 40A:12A-4(c); and
WHEREAS, the Newark Downtown Core District Redevelopment Plan has been amended twice through Ordinance 6S&FG adopted on June 17, 2005 and through Ordinance 6PSF-H adopted on May 5, 2010; neither amendment involving or changing the designation of the redevelopment entity; and
WHEREAS, the Authority was required to lead in the redevelopment efforts for various projects within the Downtown Newark area including proposed development around the Prudential Center Arena referred to as "Triangle Park;" and
WHEREAS, N.J.S.A. 40A:12A-4 authorizes the Governing Body to adopt an Ordinance to change or rescind the designation of a redevelopment entity responsible for implementing a redevelopment plan and;
WHEREAS, pursuant to N.J.S.A. 40A:12A-4, the City hereby wishes to exercise its power to change the designation of the Redevelopment Entity responsible for implementing the Newark Downtown Core ...
