WHEREAS, the City of Newark is the owner of property located at 335-347 Raymond Boulevard, Rear, also known as Tax Block 2407, Lot 81 (the "Property"); and

WHEREAS, the New Jersey Department of Transportation ("NJDOT") seeks to acquire a temporary work easement on a portion of the Property; and

WHEREAS, the City has negotiated the Site Work Agreement (the "Agreement") with NJDOT, annexed hereto as Exhibit "A", outlining the terms of access to the Property; and

WHEREAS, the Agreement provides for a temporary easement on a portion of the Property, known as "Parcel E105G", as described on the Metes and Bounds Description annexed to the Agreement as Schedule "A", and the map entitled "Parcel E105G" annexed to the Agreement as Exhibit "B"; and

WHEREAS, the duration of the temporary easement is estimated to be two (2) months from the date of acquisition; and

WHEREAS, the City of Newark has determined that Parcel E105G is no longer needed for public use; and

WHEREAS, NJDOT has provided an appraisal, annexed to the Agreement as Exhibit "C", dated May 19, 2017, performed by Raymond Underhill, which values the Temporary Work Easement Area at One Hundred Dollars and Zero Cents ($100.00); and

WHEREAS, pursuant to Local Lands and Buildings Law, N.J.S.A. 40A: 12-13 (b)(1), the City of Newark is authorized to convey property that is not needed for municipal purposes to any department of the...
