AN ORDINANCE AMENDING AND SUPPLEMENTING, TITLE XIII, FOOD, DRUGS AND COSMETICS, CHAPTER 4, MILK PRODUCTS, ARTICLE 7, ICE CREAM PEDDLERS OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED TO AMEND CERTAIN FEES AND LIMIT THE NUMBER OF LICENSES ISSUED.

WHEREAS, the City of Newark issues numerous licenses, including for ice cream and specialty drinks ("pina colada") peddlers; and
WHEREAS, the City of Newark has determined that it is necessary to adjust fees for the aforementioned licensees and impose a restriction on the number of certain licenses; and
WHEREAS, the Municipal Council finds and declares the following amendments to the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, are deemed necessary for the preservation of the public peace, health, and/or safety within the City of Newark.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

SECTION 1. Title XIII, Food, Drugs and Cosmetics, Chapter 4, Milk Products, Article 7, Ice Cream Peddlers, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, is hereby amended as follows:

The license fee to be imposed under this Article for each year shall be $1500.00 $150.00 for each wagon, pushcart, automobile, bicycle or other vehicle or receptacle from which ice cream, ices and flavored ice water are sold. The license fee to be imposed under this Article for each year shall be $1,500.00 for each automobile, motorized vehicle, wagon or other vehicle from which specialty drinks, such as pina coladas, the ice cream, ices and flavored ice water are sold.
