AN ORDINANCE AMENDING TITLE XX, OFFENSES, MISCELLANEOUS, CHAPTER 20, RULES AND REGULATIONS FOR PARKS AND RECREATIONAL FACILITIES, AS AMENDED AND SUPPLEMENTED BY THE GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, TO CREATE AND ESTABLISH SECTION 3, PEACE AND GOOD ORDER, REGULATING ROLLER SKATES, IN-LINE SKATES, SKATEBOARDS, BICYCLES, ELECTRIC SCOOTERS, DIRT BIKES AND ALL-TERRAIN VEHICLES (ATV) FOR PUBLIC HEALTH, SAFETY, AND WELFARE.

WHEREAS, in accordance with N.J.S.A. 39:3C-35, the New Jersey State Legislature has authorized municipalities to declare that the unlawful operation of an all-terrain vehicle (ATV) or dirt bike on any public street, highway or right-of-way is an immediate threat to public health, safety, and welfare, and to designate an all-terrain vehicle as contraband subject to forfeiture, pursuant to New Jersey law; and
WHEREAS, the City of Newark (the "City") finds it prudent to impose regulations on certain establishments to minimize the detrimental effects of illegally operated ATVs and off-road vehicles within the City and to further protect the public peace and good order.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

SECTION 1. The foregoing whereas clause is incorporated herein by reference and made a part hereof.
SECTION 2. Title XX, Offenses, Miscellaneous, Chapter 20, Rules and Regulations for Parks and Recreational Facilities is amended to create the following Section 3, Peace and Good Order, regulating roller skates, in-line skates, skateboards, bicycles, electric scooters, dirt bikes and all-terrain vehicles (ATVs):
