WHEREAS, the City of Newark, 920 Mayor Kenneth A. Gibson Boulevard, Newark, New Jersey 07102 (the "City") owns property located at 2047 Route 23 North, West Milford Township, New Jersey, designated as Block 14103, Lot 1; and
WHEREAS, the New Jersey Department of Transportation ("State" or "NJDOT") intends to: [i] construct a retaining wall; [ii] construct subsurface drains, a drainage outfall with rip-rap apron and appurtenances; and [iii] remove and abandon aerial Verizon cables and other related work at Route 23 Northbound from High Crest Drive to Macopin River located in West Milford Township located in Passaic County (hereinafter called the "Project"); and
