WHEREAS, on or about August 23, 2019, the City of Newark (the "City") delivered to Ascension Capital Partners I LLC (the "Redeveloper"), a deed, which was recorded on September 19, 2019, in the Essex County Register's Office as Instrument #2019088706 (2019 Deed), in connection with the private sale of various properties, including the property located at 520-526 S 16th Street, Newark, New Jersey and identified in the official tax map of the City as Block 333, Lot 59 (the "Property"), conducted pursuant to that certain Agreement for the Sale and Redevelopment of Land, authorized pursuant to Resolution 7R2-D, adopted by the Newark Municipal Council on September 19, 2018 ; and
WHEREAS, on or about May 29, 1984, the City approved the merger of the adjacent lot, Block 333, Lot 61 into Block 333, Lot 59 thereby increasing the lot size of the Property; and
WHEREAS, the 2019 Deed, which was recorded by the Redeveloper's title company, contained an inaccurate legal description that failed to include the metes and bounds reflecting the merger and therefore did not accurately describe the entire lot; and
WHEREAS, the Redeveloper recently discovered the the inadvertent error in the legal description of the 2019 Deed ; and
WHEREAS, a deed of correction is to be used for corrective or confirmatory purposes for deeds that need to be recorded or re-recorded due to a typographical, clerical, property description or other scrivener error or omission; and
