, WHEREAS, the New Jersey "Clean Communities and Recycling Act" of 1981, created the Municipal Recycling Tonnage Grant Program, whereby municipalities could receive a grant for the amount of materials documented as being recycled during the previous calendar year; and

WHEREAS, in 1987, the New Jersey "Mandatory Source Separation and Recycling Act," specifically N.J.S.A. 13:1E-99.16, mandated that municipalities submit an annual Recycling Tonnage Report summarizing the amount of material recycled during the previous calendar year; and

WHEREAS, in January 2008, the "Recycling Enhancement Act," specifically N.J.S.A. 13:1E-96.2, et seq. reestablished the State of New Jersey Recycling Fund as a non-lapsing, revolving fund, administered by the New Jersey Department of Environmental Protection ("NJDEP"), from which a tonnage grant may be provided to municipalities in order to encourage local source separation and recycling programs; and

WHEREAS, the Municipal Recycling Tonnage Grant Program does not require the submission of an official application to receive an award nor does the NJDEP issue official award letters, rather grant funds are provided to the City via direct deposit; and
