WHEREAS, the City of Newark Office of Information Technology is in need of a Customer Relationship Management System for use in various departments; and
WHEREAS, N.J.S.A. 40A:11-4.1(a) provides for the use of competitive contracting in lieu of public bidding for the procurement of specialized goods and services the price of which exceeds the bid threshold, for "the purchase of or licensing of proprietary computer software designed for contracting unit purposes, which may include hardware intended for use with the proprietary software"; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3(a), in order to initiate competitive contracting, the Municipal Council must pass a resolution authorizing the use of competitive contracting each time specialized goods or services are desired to be contracted; and
WHEREAS, the competitive contracting process shall be administered by the Business Administrator and the Office of Information Technology pursuant to N.J.S.A. 40A:11-4.3(b) and any contract awarded under this process shall be made by resolution of the Municipal Council, subject to the provisions of subsection (e) of N.J.S.A. 40A:11-4.5.
