WHEREAS, the City of Newark, in the County of Essex, New Jersey (the "City") intends to solicit a contractor to construct the Mulberry Pedestrian Bridge (the "Project"), which will serve as a landmark central pedestrian access connector to address major transportation needs for the State's largest city; and

WHEREAS, the City will require the services of a construction management consultant (the "Services") as Owner's Representative to monitor and advise the City on all aspects of the Project during the pre-construction, bidding, construction and post-construction phases; and

WHEREAS, the City desires to procure the Services utilizing the Local Public Contracts Law's (LPCL) competitive contracting provisions found at N.J.S.A. 40A:11-4.1 et seq. ("Competitive Contracting"); and

WHEREAS, the Services to be procured are permitted to be competitively procured as consulting services pursuant to the provisions of N.J.S.A. 40A:11-4.1(m); and

WHEREAS, LPCL requires that the City adopt a resolution authorizing the use of Competitive Contracting for procurement of the Services.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY THAT:
