WHEREAS, Centro Dominico-Americano of NJ and the Duartian Institute of Newark are considered New Jersey's leading cultural organizations promoting the contributions and progress of immigrants hailing from the Dominican Republic; and

WHEREAS, in tribute of their heritage here and abroad, they are desirous of having a monument of their "Founding Father" Juan Pablo Duart?, erected at a suitable location in Newark; and

WHEREAS, after several failed attempts at a suitable location, Thomas Silk Park, located at 316-334 First Street, has been selected as the ideal location.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor of the City of Newark, and /or his designee, the Business Administrator are authorized on behalf of the City, to accept the gift of the monumental statue of Juan Pablo Duart? from CENDA and the Duartian Institute of Newark, pursuant to N.J.S.A. 40A:5-29, to be displayed within the City of Newark.

2. The organizations relinquish all ownership rights to the City and shall remain in the possession of the City until it deems fit.
