WHEREAS, Resolution 7R4-c (AS) adopted March 5, 2014, authorized the Director of the Department of Engineering to execute Contract #05-2014PS Ironbound Stadium "A" Field Environmental Remediation and Football Field Restoration at Saint Charles Street, Newark, New Jersey 07105 with Weston Solutions, Inc., 1 Gateway Center, Suite 2600, Newark, New Jersey 07102, in the amount of $934,644.00; and
WHEREAS, a 'Notice to Proceed' was issued dated April 3, 2014, specifying April 3, 2014 as the effective date and ending on April 2, 2015; and
WHEREAS, on March 19, 2015, Weston Solutions advised the City in writing that all of the work could not be completed within the contract timeframe due to the following factors: (a) significant weather delays; (b) the allocation agreement was not finalized within the specified timeframe; and (c) construction delays (See Attachment A); and
