WHEREAS, the New Jersey "Clean Communities and Recycling Act" of 1981, created the Municipal Recycling Tonnage Grant Program, whereby municipalities could receive a grant for the amount of materials documented as being recycled during the previous calendar year; and

WHEREAS, in 1987, the New Jersey "Mandatory Source Separation and Recycling Act," specifically N.J.S.A. 13:1E-99.16, mandated that municipalities submit an annual Recycling Tonnage Report summarizing the amount of material recycled during the previous calendar year; and

WHEREAS, in January 2008, the "Recycling Enhancement Act," specifically N.J.S.A. 13:1E-96.2, et seq. reestablished the State of New Jersey Recycling Fund as a non-lapsing, revolving fund, administered by the New Jersey Department of Environmental Protection ("NJDEP"), from which a tonnage grant may be provided to municipalities in order to encourage local source separation and recycling programs; and
