AN ORDINANCE AMENDING TITLE XXIII, TRAFFIC, CHAPTER 3, PROHIBITED TURNS, SECTION 23:3-5, NO TURNS ON RED, OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, BY PROHIBITING RIGHT TURNS ON RED AT THE INTERSECTION OF FRELINGHUYSEN AVENUE AND EAST PEDDIE STREET (SOUTH WARD).

WHEREAS, the Department of Engineering, Division of Traffic and Signals, has determined that the intersection of Frelinghuysen Avenue and East Peddie Street in the South Ward qualifies for a "No Turn on Red" designation, in accordance with the Manual on Uniform Traffic Control Devices; and
WHEREAS, such designation will improve safety and avoid conflicts with trains at the Conrail railroad crossing that is located in close proximity to the intersection; and
WHEREAS, the Division of Traffic and Signals desires to improve safety at the signalized intersection of Frelinghuysen Avenue and East Peddie Street, in the South Ward by prohibiting right turn on red at all approaches.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
Section 1. Title 23, Traffic and Parking, Section 23:3-5, No Turns on Red, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, be amended by adding thereto the following:
Intersection Right Turn Prohibition
Frelinghuysen and East Peddie Street All right turns
Section 2. Any existing Ordinances or parts thereof inconsistent with this Ordinance are hereby repealed.
Section 3. This Ordinance shall take effect upon final passage and publication and in accordance with the laws of the State of New Jersey.
Section 4. This Ordinance does not require approval by the Commissioner of Transportation.
