WHEREAS, a suit was instituted in the United States District Court of New Jersey, Newark Vicinage, bearing Civil Action Docket Number 09--1279 (CCC), seeking recovery for personal injury damages as a result of a Civil Rights Violation on Mark Stevens by the City of Newark, and its employees individually, Anthony Venancio, Carlos Alvardo, David Nieves and Silas Smith, Jr.; and
WHEREAS, a proposal has been made to resolve said litigation by payment in the amount of Sixty Thousand Dollars, ($60,000.00); and
WHEREAS, the Corporation Counsel based upon all facts and circumstances deems it in the best interest of the City of Newark to settle the matter.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Corporation Counsel is hereby authorized on behalf of the City of Newark to execute the settlement of the Civil Action Docket Number 09-1279.
2. Upon receipt of all supporting documents by the Corporation Counsel, the Director of Finance is hereby authorized and directed to issue
a check in the amount of Sixty Thousand Dollars ($60,000.00); made payable to Mark Stevens and his attorney Andrew R. Bronsnick, Esq., of Massood & Bronsnick, LLP, 50 Packanack Lake Road, Wayne, New Jersey 07470 ...
