Body
WHEREAS, the Newark Municipal Council adopted Municipal Resolution 7R4-c on October 21, 2009, affirming support for the project “Route 1 & 9 / Haynes Avenue Operational Improvements”; and

WHEREAS, the State of New Jersey, Department of Transportation (hereinafter “NJDOT”) will construct improvements to New Jersey State Route U.S. 1 and U.S. 9 Southbound Local from Mile Post 46.50 to Mile Post 47.68 in the South Ward in the City of Newark; and

WHEREAS, said improvements will affect Haynes Avenue, Bessemer Street, Bessemer Place and International Way in the City of Newark, which are in the City’s jurisdiction and Right-of-Way; and

WHEREAS, in order to prevent future legal or maintenance disputes in these areas, it is necessary that the City of Newark and the State of New Jersey apportion the jurisdiction for highway/street maintenance and control in an equitable manner pursuant to N.J.S.A. 27:7-1 et seq.; and
