WHEREAS, the City of Newark, a municipal corporation of the State of New Jersey, (hereinafter “the City”) is the owner of the streets and the public right of way known as Raymond Boulevard and Brill Street (hereinafter “the Property”); and

WHEREAS, the County of Essex, Department of Public Works, (hereinafter “County”) having an address at 900 Bloomfield Avenue, Verona, New Jersey 07044 will construct a new 11.9 acre park along the Passaic River fronting Raymond Boulevard in the City of Newark, with a primary access point to the park at the intersection of Raymond Boulevard and Brill Street; and

WHEREAS, the County has performed a Traffic Signal Warrant Analysis at the intersection of Raymond Boulevard and Brill Street and found that the analysis justifies the installation of a new traffic signal at the intersection of Raymond Boulevard and Brill Street; and

WHEREAS, the intersection of Raymond Boulevard and Brill Street is under the jurisdiction of the City of Newark; and

WHEREAS, the County will design and construct the new traffic signal at the intersection of Raymond Boulevard and Brill Street, with no City of Newark funds required to complete this project; and

WHEREAS, the City will take responsibility for the operation and maintenance of the new traffic signal upon completion; and

WHEREAS, to facilitate project implementation and prevent future legal and maintenance issues in these areas, it is prudent that the County and the City define their respective responsibilities in an ...
