WHEREAS, two suits were instituted by Jacob’s Limousine Transportation, Inc. in the Superior Court of New Jersey, County of Essex, bearing Docket Numbers ESX-L-1791-06 and ESX-L-7321-09, seeking recovery for alleged disparate treatment under the law by the City of Newark, and its employees, individually, the City Clerk of the City of Newark, the Taxicab and Limousine Commission of the City of Newark, the Taxicab Division of the City of Newark and the Manager of the Taxicab Division of the City of Newark; and
WHEREAS, the lawsuit bearing Docket No. ESX-L-7321-09 was removed to Federal District Court for the District of New Jersey, bearing Docket Number CV-09-6331 (PGS); and
WHEREAS, a proposal has been made to resolve said litigation by payment in the amount of Three Hundred Thousand Dollars ($300,000.00), and
WHEREAS, the Corporation Counsel based upon all facts and circumstances deems it in the best interest of the City of Newark to resolve this matter by making such payment.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
