WHEREAS, pursuant to Resolution 7R1-a 090110 adopted on September 1, 2010, the Municipal Council for the City of Newark authorized the Mayor and the Acting Business Administrator to file a Consolidated Plan and a FY2010 (Program Year 2010-2011) One-Year Action Plan with the U.S. Department of Housing and Urban Development containing requests for certain grant funds, including $378,210.00 for Emergency Shelter Grant (ESG), and to accept and expend the grant awards; and
 
WHEREAS, due to the importance of the ESG Program and programs funded in whole or in part by ESG funds awarded to the City of Newark and performed or operated by local sub-recipients for the benefit of the public, as well as the importance if utilizing ESG funding in a timely manner, the Mayor and the Business Administrator believe it is in the best interest of the City and the public who benefit from these services and programs to reprogram unexpended ESG funds from prior program years to satisfy the current needs of the public; and
 
WHEREAS, pursuant to Resolution 7R1-a 031611 adopted on March 16, 2011, the Mayor and the Business Administrator were authorized to file a Substantial Amendment to the Program Year 2010 One Year Action Plan to request the de-obligation, reprogramming and redistribution of ESG funds in the total of $301,539.42; and
 
WHEREAS, on December 17, 2010, the City Newark held a fifteen (15) day citizen review period advertising the de-obligation and reprogramming of ESG funds from prior years; and
 
WHEREAS, pursuant to the fair and open process of State Pay-to-Play Law N.J.S.A.19-44A-20.5, the City of Newark publicly advertised a Request for Proposal (RFP) of these reprogrammed ESG funds on January 3, 2011 with all proposals due on January 21, 2011; and
 
WHEREAS, the proposal received from Covenant House New Jersey, Inc., 330 Washington Street, Newark, New Jersey 07102, hereinafter "Sub-Recipient," was the most advantageous to the City of Newark, based on experience and all of the criteria listed in the RFP; and
 
WHEREAS,      in consideration of current needs for the City of Newark and the amount of reprogrammable funding available, the City of Newark believes it is in the best interest of the public and in conformity with applicable grant program guidelines, to award the Sub-recipient grant dollars from reprogrammed funds in the amount of $10,102.62 to be used by the Sub-recipient to provide emergency shelter services; and
 
WHEREAS, in order to accomplish the foregoing, the Mayor and/or his designee, the Business Administrator, desires to enter into an agreement with the Sub-recipient for the purpose of providing the referenced services for the contract period January 1, 2011, through December 31, 2011 for an amount not to exceed $10,102.62; and
 
WHEREAS, the Mayor of the City of Newark signed into law Executive Order Number MEO-07-0001 (hereinafter "Pa-toPlay Executive Order"), which requires reporting of political contributions to Newark Municipal Candidates and prohibits certain political contributions during the duration of the contract.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Business Administrator, are hereby authorized to enter into and execute an agreement on behalf of the City of Newark with Covenant House New Jersey, Inc., 330 Washington Street, Newark, New Jersey 07102, for the period commencing on January 1, 2011 and terminating on December 31, 2011, to provide emergency shelter services.
 
2.      The contract between the City of Newark and the sub-recipient is hereby ratified from January 1, 2011 to the date of adoption of this authorizing resolution.
 
3.      The total amount of said contract shall not exceed $10,102.62 and shall be paid from ESG funding.
 
4.      This contract is being awarded pursuant to the fair and open procedures of the State Pay-to-Play Law, N.J.S.A 19:44A-20.5, State Local Public Contracts Law, N.J.S.A. 40A: 11-1 et seq., Emergency Shelter Grants 24 CFR 575, and is in compliance with Executive Order MEO-07-0001, effective March 31, 2007.
 
5.      As a subgrantee of Federal Funds, the City of Newark was required to and did solicit for RFPs for this contract with the sub-recipient and is compliant with Federal Laws, State PaytoPlay Laws, and State Local Public Contracts Laws entering into this contract with the sub-recipient.
 
6.      Attached hereto are two (2) certifications of funds from the Municipal Comptroller of the City of Newark, which state that there are, in total, sufficient funds for the purpose set forth hereinabove.
 
7.       An executed copy of said contract shall be filed with the Office of the City Clerk by the Business Administrator.
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Business Administrator, to enter into a contract with Covenant House New Jersey, Inc., 330 Washington Street, Newark, New Jersey 07102, utilizing ESG funding, for the purpose of providing emergency shelter services, for the period of January 1, 2011, through December 31, 2011, in an amount not to exceed $10,102.62.
