Whereas, on January 9, 2012  the Department of Water & Sewer Utilities was notified that significant erosion had occurred along the Pequannock Aqueduct, in the Township of Pequannock, and the pipe was exposed. Upon inspection it was found that the soil around the drainage ditch adjacent  to the 42-inch Pequannock Aqueduct had eroded the soil embankment protecting the pipe, and additional erosion could occur during heavy rain event to undermine the pipe and the adjacent 48-inch Pequannock Aqueduct; and
 
Whereas, due to the location of the Aqueducts between a drainage ditch and a swampy wooded area known to be wetlands, Hatch Mott MacDonald, 27 Bleeker Street, Millburn, New Jersey 07041, an engineering consultant having knowledge of the Aqueducts and the ability and experience to obtain the NJDEP permits that are needed, was contacted by the Engineering Consultant of the Department of Water & Sewer Utilities, to inspect the site and assess the condition; and
 
Whereas, on January 11, 2012 Hatch Mott MacDonald inspected the site and concurred that emergency repairs were needed to protect the Aqueduct, and provided a cost proposal for engineering services to obtain the NJDEP Flood Hazard Area General Permit, NJDEP Wetlands General Permit and any other needed permits, prepare repair specifications, and supervise construction in the amount of $36,700.00, and the cost would be increased to $40,700.00 should an individual permit be required by NJDEP; and
 
Whereas, the Department of Water & Sewer Utilities recommended that emergency purchase procedures be employed for the emergency repair of the Pequannock Aqueducts. On March 14, 2012 the Inspector General of the City of Newark authorized the Purchasing Agent to proceed with emergency purchase procedures pursuant to N.J.S.A. 40A:11-6, and Ordinance 6PSF-E 040611 stipulates that emergency contracts shall not be for a period in excess of ninety (90) days, and no extension of an emergency contract shall be permitted without authorization by the Municipal Council; and
 
Whereas, even though the Department of Water & Sewer Utilities authorized Hatch Mott MacDonald, to immediately proceed with the preparation of the specifications and obtain the necessary permits in connection with the emergency repair of the Pequannock Aqueducts, due to the time required to obtain the NJDEP Flood Hazard Area General Permit, NJDEP Wetlands General Permit and Morris County Soil Conservation permit, the emergency repair contract has to be extended beyond the ninety (90) days; and
 
Whereas, the Department of Water & Sewer Utilities wishes to extend for 120 days, the contract with Hatch Mott MacDonald, for engineering services to obtain all required permits, prepare repair specifications, and supervise the repair of the Pequannock Aqueducts on an emergency basis.
 
 
 
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Acting Director of the Department of Water and Sewer Utilities, is hereby authorized on behalf of the City of Newark, to extend for 120 days, the contract with Hatch Mott MacDonald, 27 Bleeker Street, Millburn, New Jersey 07041, for engineering services to obtain the NJDEP Flood Hazard Area General Permit, NJDEP wetlands General Permit and Morris County Soil Conservation permits, prepare repair specifications, and supervise the repair of the Pequannock Aqueducts on an emergency basis.
 
2.      No additional funding is required for this extension.
 
3.      A fully executed copy of the contract extension shall be filed in the Office of the City Clerk by the Department of Water & Sewer Utilities.
 
4.      This extension is authorized as per provisions under Ordinance 6PSF-E 040611, and the emergency purchasing provisions pursuant to N.J.S.A. 40A:11-6.
 
5.      If required by the State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than 20 business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
 
STATEMENT
 
This resolution authorizes the Mayor and/or his designee, the Acting Director of the Department of Water and Sewer Utilities, to extend for 120 days,  the contract with Hatch Mott MacDonald LLC, for engineering services to obtain the NJDEP Flood Hazard Area General Permit, NJDEP wetlands General Permit and Morris County Soil Conservation permit, prepare repair specifications, and supervise the repair of the Pequannock Aqueducts on an emergency basis.
