      WHEREAS, pursuant to Resolution 7R1-A(S), authorized on January 11, 2011, the City of Newark appropriated $53,570.00 in Community Development Block Grant (CDBG) funds to Newark School of the Arts, Inc. (hereinafter referred to as the Sub-recipient) to provide physical rehabilitation services to its' facility located at 89 Lincoln Park, Newark, New Jersey  07102; and
 
WHEREAS, pursuant to Resolution 7R1-E, authorized on June 15, 2011, the Municipal Council authorized the Mayor and/or his designee, the Business Administrator to enter into and execute an agreement with the Sub-recipient for the purpose of performing physical rehabilitation to its facility, for the contract period January 1, 2011 through December 31, 2011, in an amount not to exceed $53,570.00; and
 
WHEREAS, the Deputy Mayor/Director, Department of Economic Development desires to correct the Sub-recipient address listed in Resolution 7R1-E 061511 as 89 Lincoln Avenue, Newark, NJ  07102 to read 89 Lincoln Park, Newark, NJ  07102
 
WHEREAS, the Sub-recipient has requested authorization to extend the contract period to complete this project from January 1, 2011 through December 31, 2011 to January 1, 2011 through December 31, 2012; and
WHEREAS, this project does not require the use of additional funds and all other terms and conditions contained in the agreement authorized under Resolution 7R1-E 061511 shall remain in full effect.  
            
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a First Amended Agreement, in the form attached hereto, with the Newark School of the Arts, Inc. 89 Lincoln Park, Newark, New Jersey 07102, (hereafter referred to as the Sub-recipient) which will amend the term of the contract from January 1, 2011 through December 31, 2011 to January 1, 2011 through December 31, 2012 to allow the sub-recipient to complete the  physical rehabilitation to its facility  and reflect  the correct entity address on the Agreement as 89 Lincoln Park, Newark, New Jersey 07102
 
2.      The First Amended Agreement between the City of Newark and the sub-recipient is hereby ratified from January 1, 2011 to the date of adoption of this authorizing resolution.
 
3.      This resolution and a fully executed copy of the First Amended Agreement shall be filed with the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.
 
4.      This project does not require the use of additional funds and all other terms and conditions contained in the Agreement authorized pursuant to Resolution 7R1-E 061511 shall remain in full effect and in accordance with the law.
 
 
STATEMENT
 
This resolution hereby  ratifies and authorizes the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute a First Amended Agreement, in the form attached hereto with the Newark School of the Arts, Inc. 89 Lincoln Park, Newark, New Jersey 07102, to amend the term of the contract from January 1, 2011 through December 31, 2011 to January 1, 2011 through December 31, 2012 to allow the sub-recipient to complete the physical rehabilitation to its' facility located at 89 Lincoln Park, Newark, New Jersey 07102.
