          WHEREAS, the United States Department of Justice ("USDOJ") has made funds available through its Second Chance Adult and Juvenile Offender Reentry Demonstration Program ("Second Chance Reentry Project"), which encouraged cities to develop community-based strategies to reduce crime, violence, and recidivism by fifty percent within a five-year period; and
 
      WHEREAS, through Resolution 7R3-a, adopted March 2, 2011, the City of Newark Municipal Council ratified and authorized the Office of Reentry of the Department of Economic and Housing Development ("DEHD") in conjunction with the Office of the Business Administrator, to prepare a proposal and application to the USDOJ for grant funding in the amount of $750,000.00 for the Newark Crime Prevention and Recidivism Reduction Initiative ("NCPRRI"); and
 
      WHEREAS, on September 8, 2010, the USDOJ awarded the City a $750,000.00 grant for these services and has approved a budget that includes expenditures of $684,225.00 for Case Management, Job Placement, and Transitional Employment Services for 150 young adults, ages 18 to 30; and
 
      WHEREAS, Resolution 7R3-a, adopted March 2, 2011 further authorized the DEHD, to accept grant funds and enter into a grant agreement with USDOJ, for the grant award 2010-CZ-BX-0060, in the amount of $750,000.00, for the NCPRRI, for the period commencing on October 1, 2010 and terminating on September 30, 2011; and
 
      WHEREAS, the term for the above grant agreement was subsequently amended twice through Resolution 7R1-a 110711 and Resolution 7R3-d 060712, for the currently amended term of October 1, 2010 through December 31, 2012; and
 
WHEREAS, the City of Newark, Department of Economic and Housing Development ("DEHD"), through the Office of Reentry, is in need of Case Management, Transitional Jobs and Job Placement Services to assist in the implementation and administration of the NCPRRI; and
 
WHEREAS, pursuant to N.J.S.A. 40A:11-4.1(b) (2), a contract for such services may be awarded through a competitive contracting process; and
 
WHEREAS, the City of Newark issued a Request for Proposals in November 5, 2012, subject to the New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.4, to obtain proposals from vendors to provide the above Case Management, Transitional Jobs and Job Placement Services for the NCPRRI; and
 
WHEREAS, twelve vendors submitted proposals (the "Proposals") in response to the City's RFP; and
 
WHEREAS, the Proposals were reviewed and evaluated by a staff from DEHD, the Business Administrator's Office, and select community organizations (the "Review Committee"); and
 
WHEREAS, the grant award with USDOJ imposed certain special conditions, among which limited the City from awarding contracts, expending grant funds, or encumbering any grant funds until the City filed its 2008 and 2009 single audits with the Federal Audit Clearinghouse, which it did in December 2011; and
 
WHEREAS, Offender Aid and Restoration of Essex County, Inc., 303 Washington Street, Third Floor, Newark, New Jersey, 07102, ("OAREC") submitted a proposal to provide case management and job placement services to forty (40) young adults for the NCPRRI, and as a result was one of the vendors selected by the Review Committee due to its prior experience and proven ability as well as the quality of its proposal; and
 
WHERAS, due to the above restrictions imposed on the City by the USDOJ, the OAREC agreed to hold its bid open until such time as the City filed its 2008 and 2009 single audits with the Federal Audit Clearinghouse; and
 
WHEREAS, the City desires to enter into a contract with OAREC in the amount of $148,060.00 for the purpose of providing Case Management and Job Placement Services to forty (40)  young adults for the NCPRRI; and
 
WHEREAS, this contract is being awarded to a non-profit organization and as such is not governed by State Pay to Play Law, N.J.S.A. 19:44A-20.5, or Newark Executive Order on Pay-to-Play Reform, MEO-07-0001; and
 
WHEREAS, the contract is funded solely through the Grant Award received from the USDOJ through its Second Chance Reentry Project.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
    1. The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a Contract with Offender Aid and Restoration of Essex County, Inc., 303 Washington Street, Third Floor, Newark, New Jersey, 07102, ("OAREC") for the purpose of providing case management and job placement services to forty (40) young adults for the Newark Crime Prevention and Recidivism Reduction Initiative ("NCPRRI"), in an amount not to exceed $148,060.00, for the period commencing on April 1, 2012 and terminating on December 31, 2012.
    2. The Contract between the City of Newark and OAREC is hereby ratified from April 1, 2012 to the date of adoption of this authorizing resolution.
    3. Attached hereto is a certification of funds from the Municipal Comptroller of the City of Newark, which states that (1) there are available legally appropriated funds for the purpose set forth hereinabove in the amount of $148,060.00 and (2) that the line appropriation of the official budget which shall be charged is as follows:

    1. This contract is being awarded to OAREC as an exception to public bidding, pursuant the Competitive Contracting provisions of the State Local Public Contracts Law (N.J.S.A. 40A:11-4.1(b)(2)). Since the Fund is a non-profit organization, the procedures of the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, and Newark Executive Order MEO-07-0001, effective March 31, 2007, do not apply.
    1. A copy of the Comptroller's Certification and the fully executed contract herein authorized shall be filed in the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.
    1. The Municipal Council ratifies the use of competitive contracting for processing and awarding this contract from November 5, 2010 to the date of adoption and authorizes its use in the future.
    2. A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within ten (10) days of adoption of this Resolution.
