WHEREAS, the Municipal Council of the City of Newark on June 2, 2010, pursuant to Resolution No. 7R5-A, authorized the Mayor and/or his designee the Director of Finance to enter into a contract with Appraisal Systems, Inc., 8 Catano Avenue, Morristown, New Jersey  07960, for a total amount not to exceed $3,996,000.00, to provide services for the Revaluation of all Real Property in the City of Newark, as the only responsible and lowest bidder, in accordance with the RFP Specifications; and
WHEREAS, the Resolution and Financial Agreement provide that the term of the contract will be established for a one (1) year term pursuant to N.J.S.A. 40A:11-3(b).  The Resolution and Financial Agreement also provide that the contract may be extended for an additional year with Municipal Council approval, with no change in price and with no additional funds to be required; and
WHEREAS, the Contract was submitted to the New Jersey Department of the Treasury for their review of the Contract and they had comments and recommended amendments to the contract; and
WHEREAS, on November 4, 2010, pursuant to Resolution No. 7R5-D, the City of Newark amended the Contract granted to Appraisal Systems, Inc. to include the amendments recommended by the New Jersey Department of Treasury; and  
WHEREAS, the revaluation of all real property in the City of Newark has not been completed; and
      WHEREAS, The Essex County Board of Taxation passed a resolution on December 15, 2011 that the City of Newark undertake the requisite action to bring about the compliance, completion and implementation of a district-wide revaluation for the year 2013; and
WHEREAS, the Department of Finance is requesting authorization to enter into a First Amended Contract with Appraisal Systems, Inc., to extend the contract period to complete the revaluation of all real property in the City of Newark to December 31, 2012; and
WHEREAS, this Resolution is ratified for the period of the extension of the contract from January 15, 2012 to the date of the adoption of this Resolution; and
WHEREAS, the Mayor of the City of Newark signed into law Executive Order Number MEO-07-0001 (hereinafter "Pay-to-Play Executive Order"), which requires reporting of political contributions to Newark Municipal Candidates and prohibits certain political contributions during the duration of the contract.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.       The Mayor and/or his designee, the Director of Finance, are hereby authorized to enter into and execute a First Amended Contract, in the form attached hereto, with Appraisal Systems, Inc. located at 8 Catano Avenue, Morristown, New Jersey  07960, to extend the period of the contract until December 31, 2012, to complete the services for the revaluation of all real property in the City of Newark.   
 
2.      No additional funds shall be awarded to the Entity under this First Amended Contract.
 
3.      No additional work or assignments other than the revaluation services required under the Contract shall be given to Appraisal Systems, Inc. under this First Amended Contract.
 
4.      This resolution and a fully executed copy of the First Amended Contract shall be filed with the Office of the City Clerk by the Director of the Department of Finance.
 
5.      All other terms and conditions contained in the Contract authorized
pursuant  to Resolution No. 7R5-A, and adopted on June 2, 2010 and amended pursuant to Resolution No. 7R5-D and adopted on November 4, 2010, shall remain in full force and effect and in accordance with the law unless amended herein.
 
 
 
STATEMENT
 
Resolution ratifies  and  authorizes the Mayor and/or his designee, the Director of Finance to enter into and execute a First Amended Contract with Appraisal Systems, Inc., located at 8 Catano Avenue, Morristown, New Jersey  07960, to extend the period of the contract until December 31, 2012,  to complete the services for the revaluation of all real property in the City of Newark.
