WHEREAS, the City and Public Works Management, LLC ("PWM") entered into a contract for Special Rate and Fee Structure Studies and Development and Utility Commissions Monitoring Services ("Services"), divided into three (3) tasks, including Task 1 (Calculation of Passaic Valley Sewage Commission's Pilot Payments) for the total contract amount of $199,800.00, which the contract was authorized by Resolution 7R9-j, adopted the Municipal Council on August 3, 2011; and
WHEREAS, the City has requested and PWM has provided additional services relating to Task 1 (Calculation of PVSC's Pilot Payments), thereby necessitating a $2,925.05 increase in the contract amount to compensate PWM for those services; and
WHEREAS, the City is desirous of amending the total contract amount from $199,800.00 to an amended total contract amount of $202,725.05.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The City Clerk is hereby authorized and directed on behalf of the City of Newark to execute an Amendment to Contract with Public Works Management, LLC, 35 Janeway Place, Morris Plains, New Jersey 07950, to increase the total amount of the contract by $2,925.05, thereby amending the total contract amount from $199,800.00 to $202,725.05.
2. Attached hereto is the Comptroller's Certification, which states that there are sufficient funds in the amount of $2,925.05 available in the 2012 Temporary Budget, Fund 011, Agency 020, Organization 0202. This certification shall be filed along with the original resolution and the fully executed Amendment to Contract in the Office of the City Clerk.
3. The underlying contract and this amendment was awarded without public bidding pursuant to the extraordinary unspecified services exception of the Local Public Contracts Law, N.J.S.A. 40A:11-5(1)(a)(ii).
4. The Amendment to Contract will contain language prohibiting the making of or solicitation of any contributions during the term of the contract in violation of any state or local law.
5. A copy of the fully executed amended agreement herein authorized shall be filed in the Office of the City Clerk and shall be made available for public inspection.
6. A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement as required by law within ten (10) days of its passage.
7. The term of the contract, August 3, 2011 through August 2, 2012, remains the same.

This resolution authorizes, ratifies and amends the EUS contract between the City of Newark and Public Works Management, LLC, 35 Janeway Place, Morris Plains, New Jersey 07950, to provide Special Rate and Fee Structure Studies and Development and Utility Commissions Monitoring and additional related services by increasing the total contract amount by $2,925.05, thereby increasing the total contract amount from $199,800.00 to $202,725.05
