WHEREAS, the Division of Traffic and Signals, Department of Engineering, City of Newark, New Jersey, is in need of Engineering Consulting Services relating to the MUTCD Traffic Sign Inventory and Assessment Program; and
WHEREAS, engineering services are professional services, which are exempt from the requirement to publicly advertise for bids, pursuant to the Local Public Contracts Law, NJSA 40A:11-5 (1)(a)(i); and
WHEREAS, pursuant to the fair and open process of the State of New Jersey Pay-to-Play Law, N.J.S.A. 19:44A-20.5, the Division of Traffic and Signals, Department of Engineering, City of Newark, New Jersey,publicly advertised a Request for Proposal (RFP) on April 2, 2012, April 9, 2012 and April 16, 2012, for the MUTCD Traffic Sign Inventory and Assessment Program; and
WHEREAS, on April 24, 2012, six (6) firms submitted their responses to the Request for Proposal (RFP); and
WHEREAS, a selection committee of personnel from the Department of Engineering and the North Jersey Transportation Planning Authority, evaluated the six (6) proposals and selected KS Engineers, P.C., 494 Broad Street,, 4th. Floor, Newark, New Jersey 07102, for the MUTCD Traffic Sign Inventory and Assessment Program, because their proposal was unanimously selected by the selection committee for Quality and Presentation of the Proposal, Project Understanding and Overall Project Team Experience; and
WHEREAS, the Director of the Department of Engineering desires to accept the proposal submitted by KS Engineers, P.C., 494 Broad Street,, 4th. Floor, Newark, New Jersey 07102, for the MUTCD Traffic Sign Inventory and Assessment Program in an amount not to exceed $349,525.70.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
- The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to accept the proposal dated April 24, 2012 and revised on June 22, 2012, which was submitted by KS Engineers, P.C., 494 Broad Street,, 4th. Floor, Newark, New Jersey 07102, and execute Contract No. 08-2012PS, for the MUTCD Traffic Sign Inventory and Assessment Program, in an amount not to exceed $349,525.70.
- Attached hereto is a certification of funds issued by the Chief Financial Officer, City of Newark, New Jersey, which states that there are available sufficient legally appropriated funds for the purposes set forth hereinabove. A copy of the certification of funds issued shall be filed in the Office of the City Clerk by the Director of the Department of Engineering together with this resolution.
- No changes to this contract will be allowed without prior Municipal Council approval.
- A fully executed copy of the contract shall be filed in the Office of the City Clerk by the Director of the Department of Engineering and available for inspection.
- This contract is to be completed within a period of 365 consecutive calendar days from the date of the issuance of a formal Notice to Proceed by the Director of the Department of Engineering.
- The public bidding process under the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1, complies with the Fair and Open Process of the State of New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5 as a Fair and Open contract, and is in compliance with Executive Order MEO-07-0001, effective March 31, 2007.
- There shall be no advance payments made against this contract in accordance with N.J.S.A. 40A:5-16.
- Funds for this contract in the amount of $349,525.70 are provided from the Budget as stated below:

- A notice of this action shall be placed in the newspaper as required by law within ten (10) days of the adoption of this resolution.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Director of the Department of Engineering, on behalf of the City of Newark, to accept the proposal dated April 24, 2012 and revised on June 22, 2012, submitted by KS Engineers, P.C., 494 Broad Street,, 4th. Floor, Newark, New Jersey 07102, and execute Contract No. 08-2012PS, for the MUTCD Traffic Sign Inventory and Assessment Program, in the amount not to exceed $349,525.70.
