WHEREAS, permission is required of the Director of the
Division of Local Government Services for approval to establish a
Dedicated Trust by Rider of revenues received by a municipality when
the revenue is not a subject to reasonable accurate estimates in
advance; and
WHEREAS, Ordinance 6PSF-B-050510 amends Subsection 7 to Title 2, Chapter 2, Section 64, to authorize the City of Newark to impose an application fee for persons seeking representation by the
Office of the Municipal Public Defender as authorized by N.J.S.A. 2B:24-17;and
WHEREAS, N.J.S.A. 40A:4-39 provides that the Director of the
Division of Local Government Services may approve expenditures of
monies by dedication by rider.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL
OF THE CITY OF NEWARK,
NEW JERSEY,THAT:
1. The Mayor and/or his designee, the Director of Finance, is
hereby authorized by the Municipal Council of the City of Newark to
request permission of the Director of the Division of Local Government
Services for the approval to establish a Dedicated Trust by Rider for revenues, pursuant to N.J.S.A. 40A:4-39, for the following fees collected by the City of Newark:
Application fee for representation by the Office of the
Municipal Public Defender pursuant to N.J.S.A. 2B:24-17.
2. These dedicated revenues are hereby appropriated for the purpose
to which said revenue is dedicated by statute or other legal requirement, in this instance, to support the
